A aplicação de coimas às autarquias locais por violação do RGPD

Abstract

No presente artigo procurar-se-á contribuir para a superação de algumas das principais dúvidas enfrentadas pelas autarquias locais, relativamente ao regime sancionatório pecuniário previsto no Regulamento Geral sobre a Proteção de Dados e na Lei n.º 58/2019, de 8 de agosto: (i) por um lado, esclarecendo em que circunstâncias estas podem ser sujeitas à aplicação de coimas, nos termos daqueles diplomas; (ii) por outro lado, analisando quais as concretas situações que, na prática, já levaram a que essas sanções lhes fossem efetivamente impostas por parte da autoridade de controlo portuguesa.

The present article aims to overcome some of the main doubts presented by local public authorities regarding the system of administrative fines provided for in the General Data Protection Regulation and in the Law no. 58/2019, of 8th August: (i) at the one hand, explaining in what circumstances they can be subject to that kind of penalties, under the said legal instruments; (ii) at the other hand, analysing the concrete situations that already led such penalties to be imposed upon them, by the Portuguese supervisory authority.
