Resumo(s): | Progressivamente, e ao longo dos anos, a magistratura do Ministério Público e as
competências que lhe foram sendo confiadas sofreram uma profunda evolução, que teve lugar
ao sabor das exigências de justiça e de administração do ordenamento jurídico português, que
se fizeram sentir em cada momento histórico.
Na verdade, o magistrado do Ministério Público não é, atualmente, apenas e só, o
“funcionário promotor do crime”, que atua no exercício da ação penal. Pelo contrário, o
magistrado do Ministério Público conta hoje com uma ampla panóplia de competências, que
se distribuem por diversos domínios. Ao Ministério Público, órgão do poder judicial, compete,
à luz do disposto nos artigos 219.º, da Constituição da República Portuguesa e 1.º, do Estatuto
do Ministério Público, para além da participação na execução da política criminal e do
exercício da ação penal, a representação do Estado, a defesa dos interesses que a lei determinar
e a defesa da legalidade democrática. Note-se, todavia, que esta polifuncionalidade não
constitui uma manta de retalhos: apesar da diversidade, as funções do Ministério Público
formam um todo coerente e interligado. No que à atuação da magistratura do Ministério Público no processo tributário diz
respeito, igualmente se consegue denotar uma profunda evolução da sua concreta configuração
e das funções que, nesse âmbito, lhe têm sido conferidas. Especificamente quanto à função de
representação da Fazenda Pública no processo tributário, desde 1984 que a mesma deixou de
estar incluída no leque das competências atribuídas ao Ministério Público, tendo sido operada
uma rutura difícil de compreender e de justificação discutível. Progressively, and along to the years, the judiciary of the Public Ministry and competencies which were being entrusted suffered a deep evolution that took place at the whim of the demands of justice and legal order of the Portuguese administration that were felt in every historical moment.In fact, the judiciary of the Public Ministry is currently not only the official promoter of the crime. On the contrary, now He has a wide range of competences distributed in various domains. In the light of the article 219th of the Constitution of the Portuguese Republic, it is the Public Ministry responsible for involvement implementing the criminal policy and the exercise of criminal action, the representation of the Portuguese State, protecting the interests that the law determines, and defense of democratic legality. Despite the diversity, the functions of the Public Ministry form a whole that is coherent and interconnected. Concerning to its role in the tax process, we can verify a deep and consistent evolution in his duties on the role of Public Ministry in tributary process. We can also denote a deep evolution of this actual form and function, conferred to them. In this article, precisely, we study the role of the tax authorities in the tributary process, that since 1984 is no longer included in the range of competences assigned to the Public Ministry assigned to the Public Ministry. It was made a difficult break to understand and arguable justification. |
