O estereótipo do criminoso e a sua influência no Sistema Criminal Brasileiro

Abstract

O sistema jurídico criminal brasileiro é representado por um conjunto de instituições, dentre elas, a instituição policial, judiciária e penitenciária, que atuam dentro dos limites estritos da lei, com o objetivo de garantir e manter uma ordem social justa. Nesse sentido, importa entender a influência dos estereótipos nas ações e decisões dos operadores do Direito, em especial, os magistrados e a força policial. Portanto, este trabalho se dedica a estudar, inicialmente, o criminoso, com base em determinadas teorias criminológicas, bem como estabelecer o surgimento e a caracterização do estereótipo do criminoso brasileiro, de acordo com a análise do contexto histórico, social e econômico do país, durante o final do século XIX e início do século XX. Posteriormente, com a análise de pesquisas doutrinárias e dados estatísticos, pode-se afirmar que o público-alvo da atuação repressiva do Estado e da Justiça é representado pelo homem jovem, negro (preto e pardo), pertencente das classes mais baixas da sociedade e residente das áreas periféricas, as chamadas «favelas». Diante do exposto, nota-se a necessidade de um esforço coletivo, da sociedade, do Estado e do Poder Judiciário, no combate a possíveis condutas discriminatórias e intolerantes, na tentativa de alcançar a justiça real.

The Brazilian criminal legal system is represented by a set of institutions, among them the police, judiciary, and penitentiary institutions, which act within the strict limits of the law, with the objective of guaranteeing and maintaining a just social order. In this sense, it is important to understand the influence of stereotypes on the actions and decisions of the operators of the Law, especially the magistrates and the police force. Therefore, this work is dedicated to study, initially, the criminal, based on certain criminological theories, as well as to establish the emergence and characterization of the stereotype of the Brazilian criminal, according to the analysis of the historical, social and economic context of the country, during the end of the XIX century and beginning of the XX century. Later, with the analysis of doctrinal research and statistical data, it can be affirmed that the target public of the repressive action of the State and Justice is represented by the young black male (black and brown), belonging to the lower classes of society and resident in the peripheral areas, the so-called «favelas». Considering the above, we can see the need for a collective effort by society, the State, and the Judiciary to combat possible discriminatory and intolerant conduct in an attempt to achieve real justice.
