A responsabilidade civil pelos danos causados por atos autónomos da Inteligência Artificial

Abstract

A inteligência artificial encontra-se em constante evolução, encontrando-se cada vez mais presente no nosso dia-a-dia e consequentemente provocando mais danos. Assim, a tarefa principal desta dissertação passará por responder à questão de quem será responsabilizado pelos danos causados pelos sistemas de IA, que se encontram mais autónomos e próximos do ser humano, e através de que mecanismos legais se poderá verificar essa responsabilização. Para isso, esta análise começará por (1) definir inteligência artificial e a autonomia destes sistemas e ainda contextualizá-los nas legislações do mundo; em seguida, (2) considerando a autonomia dos sistemas de IA, analisará a possibilidade de conceção de personalidade jurídica a estes e desmembrará os pressupostos da responsabilidade civil face aos sistemas de IA; por fim, (3) tendo em conta os contributos inegáveis da União Europeia nesta matéria, procederá à análise das propostas desta união económica e política, e, finalmente analisará a responsabilização pelos danos causados por atos autónomos dos sistemas de IA no contexto do ordenamento jurídico português.

Artificial intelligence is constantly evolving, finding itself increasingly present in our daily lives and consequently causing more damages. Thus, the main task of this dissertation will be to answer the question of who will be held responsible for the damage caused by AI systems, which are more autonomous and closer to human beings, and through what legal mechanisms this liability can be verified. Therefore, this analysis will start by (1) defining artificial intelligence as well as the autonomy of these systems and contextualizing them in the world's legislation; then, (2) considering the autonomy of AI systems, it will analyse the possibility of conceiving a legal personality for them and will dismantle the assumptions of civil liability vis-à-vis AI systems; finally, (3) taking into account the undeniable contributions of the European Union in this matter, it will analyse the proposals of this economic and political union, and, finally, it will analyse the liability for damage caused by autonomous acts of AI systems in the context of the Portuguese legal system.
