A dissolução da união de facto: efeitos patrimoniais

Abstract

O principal objetivo da presente dissertação consiste em analisar todas as consequências decorrentes do término de uma união de facto, bem aquilatar a forma como o ordenamento jurídico português regula as uniões de facto, sobretudo em termos patrimoniais. Para tal, analisaremos a Lei n.º 7/2001, de 11 de maio, e subsequentes alterações. Num primeiro capítulo tentaremos avançar com uma definição de união de facto, o que obrigará à análise comparada do respetivo regime com o regime do matrimónio, e dos efeitos que dali resultam, de forma a fazer um enquadramento do tema que nos propomos desenvolver. Ora, aí poderemos já restringir o objeto da nossa tese, já que, não obstante se levantarem inúmeros problemas entre os membros da união de facto durante a sua vigência, apenas iremos focar-nos nas problemáticas que surgem quando aquela relação chega ao seu termo, o que pode ocorrer de forma voluntária, quando as partes, ou apenas uma delas, decide por fim à relação, ou de forma involuntária, quando um dos membros falece. Consequentemente, no capítulo que se segue, iremos abordar a dissolução da união de facto nos casos em que esta opera de forma voluntária, analisando quais os efeitos patrimoniais que daí decorrem, bem como a abordagem jurídica que é feita a essas situações pelo nosso ordenamento. Finalmente, num último capítulo, será feita a análise das situações de dissolução da união de facto de forma involuntária e do respetivo regime jurídico, procurando desenvolver todas as problemáticas e controvérsias jurisprudenciais que se têm constatado neste âmbito. A questão central da investigação a que nos propomos consiste em procurar dar resposta à questão de saber se o regime jurídico aplicado às uniões de facto no ordenamento jurídico português será, efetivamente, o mais eficaz ou se, por outro lado, é urgente a introdução de novas atualizações.

The main gold of this master thesis is to analyze all the consequences that exist when a relationship between two unmarried people comes to an end, as well as the way the Portuguese juridical system handles these kind of relationships, in patrimonial terms. To this end, we will be analyzing the Law n. º 7/2001, from 11/05, and its subsequent alterations. In a first chapter the exposition will begin by giving the possible definition of what cohabiting is, proceeding to the compared analysis between this regime and the matrimonial regime, as well as the effects that result from cohabiting, in order to framework the theme we propose to develop. As we can see, at the time the two people are cohabiting, problems may arise between them, but we will only concentrate in the problems that appear when the relationship comes to an end. This end can be voluntary, when the members, or only one of the members, decide to put an end to the relationship, or involuntary, when one of the members dies. Therefore, in the second chapter we will approach the voluntary termination of the relationship, analyzing all the patrimonial effects involved as well as the juridical approach that is made to those situations by the Portuguese legal system. Finally, in the last chapter, will be analyzed the involuntary termination of these relationships, as well as the legal regime applied to these situations, seeking to develop all the controversies attached to this issue. With this exposure, we aim to identify if the legal regime applied, in the Portuguese legal system, to these relationships is the right one or if it should be slightly changed.
