dc.description.abstract | A mutilação genital feminina é uma prática que existe há milhares de anos, principalmente em países africanos e do Médio Oriente. É reconhecida pela OMS e pela ONU como uma das práticas que mais afeta a saúde de milhões de crianças e mulheres. Se antes estava circunscrita a uma parte do globo, com os constantes fluxos migratórios originários de África, são cada vez mais os países ocidentalizados que reconhecem que a MGF é prática recorrente em seus territórios, trazida pelas diversas comunidades étnicas que veem este ritual como uma parte identitária da sua cultura. De modo a eliminar esta prática, são vários os instrumentos internacionais e regionais que as condenam, exigindo aos Estados em que a MGF é praticada a sua criminalização, assim como a educação da sociedade para os malefícios que deste ritual advêm, que vão contra aquilo a que reconhecemos como Direitos Humanos, principalmente direitos das mulheres e das crianças. Portugal é considerado pela OMS um país de risco em relação à mutilação genital feminina, pois é um país de acolhimento de imigrantes africanos para os quais a MGF é uma realidade. Esta dissertação, além de fazer um enquadramento geral acerca da mutilação genital feminina no mundo e especificamente em Portugal, visa apresentar quais as razões que levaram, em Agosto de 2015, à introdução no Código Penal Português 144.º A cuja epígrafe é “Mutilação Genital Feminina”, atendendo para isso aos debates políticos promovidos em 2004 e em 2014. | por |
dc.description.abstract | Female Genital Mutilation (FGM) is a practice that has been around for millions of years, mainly in African and Middle East countries. It is recognized by the WHO and the UN as one of the procedures that most affects the health of millions of women and children. If before it was limited to a part of the globe, today on account of the constant migratory fluxes from Africa, more and more westernized countries recognize that FGM is a recurrent practice in their territories, brought by the miscellaneous ethnical communities that regard this ritual as a part of their cultural identity. In such a way as to eliminate this practice, there are many international and regional instruments that condemn it, demanding its criminalization by the states in which FGM is conducted, as well as the raising of awareness in their societies in regard to the ritual’s consequences that go against what we recognize as Human Rights, mainly women and children’s. The WHO considers Portugal a country at risk in terms of female genital mutilation, since it is a host country for African immigrants to whom FGM is a reality. In addition to the overall framework regarding the practise of female genital mutilation across the world, and more specifically in Portugal, this thesis also intends to present the reasons behind the introduction, in August 2015, of the Article 144-A in the portuguese Penal Code, taking into account the political debates that took place in 2004 and 2014. | por |
