Resumo(s): | O exercício das funções policiais na qualidade de agente da Polícia de Segurança Pública,
ligadas à prática forense, e actualmente na inspeção tributária, possibilitou a realização do
presente relatório ligado ao tema proposto, do qual fazem parte as várias matérias ali
referenciadas e de certa forma abrangentes, as quais consideram-se importantes e pertinentes,
resultado da experiência profissional adquirida, dada a necessidade que existe na recolha de
forma legal dos meios de (obtenção) prova em processo penal e o seu valor probatório,
perante a prática dos tipos de ilícitos criminais e infrações fiscais, não só pelas dificuldades
resultantes nessa obtenção por parte dos Órgãos de Polícia Criminal (OPC), como também
pelos vários departamentos de Inspeção Tributária (IT) da Autoridade Tributária e Aduaneira
(AT) e que importa analisar.
Numa primeira parte é feita a referência ao próprio regime orgânico e estatutário da Polícia de
Segurança Pública e um estudo sobre a atuação policial numa fase anterior ao início do
processo penal, ou seja, as chamadas medidas cautelares e de polícia.
Numa segunda parte abordam-se os meios de (obtenção) prova mais utilizados no exercício
destas funções, constantes no sistema jurídico português, concretamente no que respeita aos
exames, à revista e às apreensões, bem como chamar à colação algumas divergências
doutrinais e também jurisprudenciais, jurisprudência que é exclusivamente abordada na quarta
parte. Aqui abrange-se, sobretudo a complexidade e validade na aquisição dos meios de
(obtenção) prova, na atividade policial.
A terceira parte o estudo, intimamente ligada à segunda incide sobre os meios de prova. Uma
abordagem relativa à questão do valor da prova por reconhecimento em sede de investigação e
inquérito de pessoas e posteriormente na fase de julgamento, do depoimento indireto,
terminando igualmente na referência da visão jurisprudencial relativa ao valor probatório das
declarações do arguido perante as autoridades policiais, divergentes daquelas declarações
produzidas em tribunal dentro do mesmo processo. De igual forma são referenciadas as
decisões jurisprudenciais relevantes nesta matéria bem como a sua evolução em algumas
questões, na quarta parte do estudo. Na quinta e última parte, procede-se à abordagem dos meios de (obtenção) de prova a
produzir com relevância no âmbito da atuação policial e no procedimento de inspeção
tributária, nomeadamente, as medidas cautelares e de polícia por um lado, e os meios de prova utilizados no Procedimento de Inspeção Tributária, nomeadamente a prova documental e
testemunhal, por outro. O presente relatório debruça-se também, ainda que de forma sucinta,
sobre a obtenção da prova digital, questão que se tem revelado actual, uma vez que a evolução
tecnológica em geral e a criação dos sistemas informáticos da Administração Fiscal na sua
relação com os contribuintes, em particular, tem vindo a implicar o aparecimento de novos
“modus operandi” em relação a certos ilícitos típicos, mais concretamente no que respeita à
falsificação na emissão de faturas através de aplicações informáticas e programas certificados
de faturação. The exercise of police functions in the Police Agent of Public Security, linked to forensic practice, and currently in the tax inspection, made possible the development of this report on the proposed theme, which comprises the various materials referenced there and somehow comprehensive, which are considered important and relevant as a result of professional experience, given the need that exists in the collection of legal form of the means of (obtaining) evidence in criminal proceedings and their probative value, given the practice of the types of illicit criminal and tax offenses, not only by the difficulties arising in this achievement by the criminal Police Bodies (OPC), but also by the various departments of tax Inspection (IT) of the Tax and Customs Authority (TA) and which should be examined. The first part is made reference to own organic and statutory regime of the Public Security Police and a study on police action earlier in the beginning of the criminal process, ie, the socalled precautionary measures and police. In the second part means up approach of (obtaining) proves used in the exercise of these functions, constants in the Portuguese legal system, particularly with regard to examinations, the magazine and the seizures and call into play some doctrinal differences and also jurisprudential , jurisprudence which is exclusively addressed in the fourth part. Here covers, above all the complexity and validity in the acquisition of the means of (obtaining) evidence at the police activity. The third part of the study, closely linked to the second focuses on the evidence. One approach to the issue of probative value for recognition based research and investigation of people and later at the trial stage, the indirect testimony, also ending in reference jurisprudential vision for the probative value of the statements of the accused to the police authorities, divergent from those statements made in court within the same process. Likewise are referred to the relevant court decisions in this area and their evolution on some issues, in the fourth part of the study. In the fifth and final part, proceeds to the media approach of (obtaining) the evidence to be of relevance in the context of policing and tax inspection procedure, including the precautionary measures and police on the one hand, and the means test used in the procedure of Tax Inspection, including the documentary and testimonial evidence, on the other. This report focuses also, albeit briefly, about getting the digital proof, an issue that has proved to be current, since the technological development in general and the creation of the IT systems of the tax authorities in their relationship with the taxpayers, in particular, has lead to the emergence of new "modus operandi" for certain typified, specifically with regard to the issuance of fake invoices via computer applications and billing certificate programs. |
