Resumo(s): | O crédito tornou-se num instrumento importante e indispensável na participação no
mercado, tanto para as empresas como para os consumidores, abrangendo todas as classes
sociais no tocante a estes últimos.
As instituições financeiras, com o objetivo de atender a estes interesses têm vindo a criar
e difundir várias espécies de contratos bancários para concessão de crédito, configurando o
contrato de abertura de crédito uma das formas contratuais mais utilizadas, sendo vulgarmente
conhecido por “linhas de crédito”.
Ora, as instituições financeiras apenas concedem créditos aos sujeitos, quer sejam
empresas, quer sejam pessoas singulares, contra a prestação de garantias. Pelo que as partes
terão liberdade para escolher e acordar entre si a garantia ou garantias que mais se coadunam
com a situação em concreto e que melhor asseguram o cumprimento das obrigações
emergentes do contrato de abertura de crédito.
As garantias associadas a esta forma contratual são diversificadas e com especificidades
próprias, daí o nosso interesse em estudar tais realidades quer a nível da sua caracterização,
quer a nível de soluções no caso de surgirem vicissitudes.
Assim, a dissertação que nos propomos a elaborar procurará caracterizar o contrato de
abertura de crédito como ponto de partida para, em seguida, analisar as garantias bancárias
mais usais em sede de contrato de abertura de crédito, fazendo uma análise do regime legal
vigente de cada uma e, em especial, das caraterísticas decorrentes da sua prestação em sede
de abertura de crédito. Credit has become an important and indispensable instrument in market share, both for businesses and for consumers, covering all social classes with respect to these last. The financial institutions, with the objective of serve these interests have been creating and disseminating several species of bank contracts for credit concession. The credit facility agreement configures one of the most used types of contract, being commonly known as "credit lines ". However, financial institutions only provide credit to companies or individuals, if they present some warranty. The parts will be free to choose and agree on the guarantee or warranty that more fit into concrete situation and what better ensure compliance with the obligations arising from the credit facility agreement. The guarantees associated with this contractual form are diverse and specific, hence our interest in studying these realities both in terms of its characterization, both in terms of solutions that should arise from the vicissitudes. Therefore, the dissertation we propose to develop will seek to characterize the credit facility agreement as a starting point to then analyze the more frequent thirst bank guarantees in place of a credit facility agreement, making an analysis of the current legal regime of each one, in particular the characteristics resulting from its association with the credit facility agreement. |
