A crise do Estado de Direito na União Europeia – uma análise com base no regulamento (UE, EURATOM) 2020/2092 do Parlamento Europeu e do Conselho de 16 de Dezembro de 2020 relativo a um regime geral de condicionalidade para a proteção do orçamento da União

Abstract

O princípio do Estado de Direito constitui um dos pilares essenciais do processo de integração europeia, em termos de a própria União ser mesmo referida como uma "União de Direito". Atenta essa essencialidade, compreende-se a permanente vigilância que as instituições da União e dos Estados membros lhe dispensam, suscitando reações imediatas quando se sinalizam debilidades que podem fazer perigar os valores jurídicos essenciais relacionados, por exemplo, com a separação de poderes, a independência dos juízes, a legalidade da administração ou a segurança jurídica. No presente trabalho, tentaremos analisar uma dessas reações, materializada no regulamento (UE, EURATOM) 2020/2092 do Parlamento Europeu e do Conselho de 16 de Dezembro de 2020, que condiciona a atribuição de fundos da União Europeia ao respeito pelo Estado de Direito, erigindo o Orçamento da União a ferramenta essencial na defesa do próprio edifício comunitário.

The rule of law principle constitutes one of the essential pillars of the European integration process, in terms of the Union itself being referred to as a "Union of Law". Bearing in mind this essentiality, it is understandable the permanent vigilance that the institutions of the Union and of the Member States dispense with it, provoking immediate reactions when weaknesses are signaled that can jeopardize essential legal values related, for example, with the separation of powers, the independence of judges, the legality of the administration or legal certainty. In the present work, we will try to analyze one of these reactions, materialized in the regulation (EU, EURATOM) 2020/2029 of the European Parliament and of the Council of December 16, 2020, which condition the allocation of European Union funds to the respect for the rule of law by the Member States, making the Union Budget the essential tool in the defense of the community building itself.
