Resumo(s): | Esta tese tem como fundamental escopo investigar se o fortalecimento da
denominada justiça criminal negocial no Brasil (algo que também ocorre em vários outros
países) é incompatível com a ideia de um sistema penal essencialmente democrático e
garantidor de direitos fundamentais de todo cidadão. Para atingir este desiderato,
percorreu-se um longo caminho, ocasião em que diversos temas foram abordados, todos
irmanados em suas relevâncias para o desvelamento da temática central da investigação.
O Brasil é marcado pelas chagas trazidas de sua colonização e utilização de um
sistema de produção baseado na escravidão. Estes são os pilares da gênese de uma
sociedade que surgiu de um contexto marcado pelo autoritarismo e do racismo e que
engendrou uma deletéria (e duradoura) desigualdade social. Como o Direito não permanece
alheio aos demais sistemas sociais, ele absorveu para si estes elementos e os traduziu em
uma normatividade que, em que pese ter experimentado momentos mais afetos ao
humanismo, mantem-se como perverso instrumento de controle social daqueles cuja
presença e liberdade não agradam as elites políticas e econômicas.
Em momentos muito importantes da história do país, como por exemplo o processo
de sua independência, a abolição formal da escravidão ou até mesmo o período de
“redemocratização” após a ditadura civil militar, observa-se que não houve um movimento
de origem popular que, efetivamente, acarretasse uma mudança estrutural na sociedade
brasileira. Pelo contrário, estes acontecimentos ocorreram a partir de acordos efetuados
pelas elites, cujas intenções sempre foram proteger seus privilégios.
Mesmo com a promulgação da constituição de 1988, não se verificou uma mudança
da mentalidade da sociedade brasileira, que ainda perpetua seu caráter autoritário, razão
pela qual serve de fértil substrato às atuais práticas neoliberais que promovem o desmonte
do bem-estar social, desestruturam os laços de solidariedade da comunidade e incentivam
relações pautadas na eficiência. Os princípios democráticos submetem-se aos interesses do
grande capital. O Direito é colonizado pela racionalidade neoliberal, sendo a justiça criminal
negocial o maior sinal da chegada a um Estado que, graças à possibilidade de todo cidadão
poder negociar seus direitos fundamentais como se mercadorias fossem, não pode se dizer
democrático, mas sim, pós-democrático. This dissertation´s main scope is to investigate whether the fostering of so-called negotial criminal justice (something that also takes place in many other countries) is incompatible with the idea of a penal system essentially democratic and safeguarding of the fundamental rights of every citizen. To reach this target, a long path has been traced, whereby several themes were approached, their relevances harmonized so as to unveil the core theme of this work. Brazil is plagued by its legacy of a colonial past, where production systems based on slavery prevailed. Such structures were the pillars in the inception of a society that emerged out of a context of authoritarianism and racism, which in turn engendered deleterious (and long-lasting) social inequalities. Since it´s legal system operates within that social background, it bears those undesirable elements. Though it did witness more equitable moments, it remains an instrument of social control for those whom prospects of freedom on the part of others are not appealing to political and economic elites. During key events of this country’s history, for instance its process of independence, the legal abolition of slavery, or even its “redemocratization” following an era of dictatorship, it so happened that grassroots movements seeking the overhaul of Brazilian social structures at a societal level did not take place. On the contrary, these milestones were all carried out according to machinations stemming from the elites, whose intentions were always to protect their privileges. Even with the advent of its 1988 constitution, whose democratic nature is evident, a significant change in mentality within the Brazilian society was not observed. It perpetuates an authoritarian essence, reason for which that country is fertile ground for neoliberal policies that discourage Welfare practices, doing away with solidarity ties within communities, instead promoting efficiency, productivity, and competitivity. This way, democratic principles are subjected to the interests of capitalist forces. The legal system is thus conditioned, colonized, by neoliberal reasoning, negotial criminal justice being the greatest sign of a state which, thanks to the fact that every citizen may negotiate their fundamental rights as though they were commodities, cannot be called democratic, but rather post-democratic. |
