Resumo(s): | A presente dissertação é parte da linha de pesquisa de Direito e Jurisdição. Objetiva analisar a videoconferência no Direito da União Europeia e a ata notarial no Direito Brasileiro, bem como a tutela jurisdicional efetiva por referência a estes dois ordenamentos jurídicos. Justifica-se ante a necessidade da pesquisa pela existência e disponibilidade dos dois institutos: a videoconferência no Direito da União Europeia e a ata notarial no Direito Brasileiro, considerando, principalmente, a potencial melhoria da prestação jurisdicional, com o uso de tais ferramentas, o que confere maior efetividade. Além da possibilidade, cumpre ressaltar a importância da adoção de tecnologias que tornam o acesso à jurisdição uma realidade mais próxima do cidadão, usuário dos serviços notariais. Há que se falar de acesso à justiça e celeridade processual, considerando o cenário delicado do judiciário brasileiro, quer seja, alta demanda de litígios somado à carência de métodos eficientes para tornar o processo ao mesmo tempo rápido e com resultado satisfatório, o que congestiona as varas pelo país. A fim de atingir o aludido objetivo, parte da análise da tutela jurisdicional e evolui para a tutela jurisdicional efetiva, examinando a videoconferência e a ata notarial como ferramentas que implementam concretamente o princípio da eficiência processual, indo beber influências concretizadoras à latitude europeia, atentando às soluções decorrentes do direito da União Europeia. Este estudo demonstra que a videoconferência na União Europeia e a ata notarial no Brasil são concretizadores do princípio da eficiência processual. O método utilizado foi o indutivo, com uso da pesquisa bibliográfica e do referente. This dissertation is part of the Law and Jurisdiction research line. It aims to analyze the videoconference in European Union Law and the notary minutes in Brazilian Law, as well as effective judicial protection by reference to these two legal systems. It is justified in view of the need for research due to the existence and availability of the two institutes: the videoconference in European Union Law and the notary minutes in Brazilian Law, considering, mainly, the potential improvement of the jurisdictional provision, with the use of such tools, the that gives greater effectiveness. In addition to the possibility, it is important to emphasize the importance of adopting technologies that make access to the jurisdiction a reality closer to the citizen, a user of notary services. It is necessary to talk about access to justice and procedural speed, considering the delicate scenario of the Brazilian judiciary, that is, high demand for litigation added to the lack of efficient methods to make the process both fast and with satisfactory results, which congests the sticks across the country. In order to achieve the aforementioned objective, it starts from the analysis of jurisdictional protection and evolves to effective jurisdictional protection, examining the videoconference and the notary minutes as tools that concretely implement the principle of procedural efficiency, going to drink concretizing influences to the European latitude, paying attention to the solutions resulting from European Union law. This study demonstrates that the videoconference in the European Union and the notary minutes in Brazil are concretizers of the principle of procedural efficiency. The method used was the inductive one, with the use of bibliographic research and referent. |
