Condicionalismos à transparência das freguesias: o caso do distrito de Braga

Abstract

A transparência da administração constitui uma condição para a efetiva participação dos cidadãos na formação das decisões ou deliberações que lhes digam respeito pelo que foi muito relevante verificar, se o caminho percorrido pelos Presidentes de Junta do distrito de Braga permitiu aos cidadãos uma avaliação justa da sua ação autárquica durante o mandato de 2013 a 2017. Com o regime jurídico das autarquias locais (RJAL), que permitiu a transferência de competências (contratualizada) a favor das freguesias, surgiram os contratos interadministrativos, através dos quais o município delega competências que são suas, nas freguesias transferindo as respetivas verbas para a sua concretização. Considerou-se assim, muito relevante verificar se há transparência na publicitação das verbas recebidas para a concretização da delegação de competências com o município, tendo como pressuposto de que a diferença entre o valor recebido e o valor publicitado é uma falha nos valores públicos, impossibilitando que outros valores mais altos se levantem como a transparência e a accountability. Nesta dissertação efetuou-se uma análise descritiva de todos os concelhos do distrito de Braga ao alinhamento político-partidário entre o Município e as Juntas de Freguesia, ao género e ao número do mandato dos eleitos, à ideologia política, número de habitantes das freguesias e às habilitações literárias dos autarcas. Para verificar a influência destas variáveis utilizou-se o Modelo probit e realizou-se um teste à significância das médias, mediante a utilização de um Teste t. Os resultados obtidos no presente estudo foram reveladores de uma grande diferença entre os valores transferidos dos municípios para as freguesias e os valores publicados por estas. Os testes realizados permitiram estabelecer que o alinhamento político-partidário e o número do mandato exercem uma influência negativa sobre a transparência, ao contrário da variável população das freguesias, que exerce uma influência positiva. Os Testes t realizados ao alinhamento político-partidário e ao género dos autarcas, demonstraram que a diferença de médias verificadas entre as freguesias politicamente alinhadas não é estatisticamente significativa quando comparada com as freguesias politicamente não alinhadas. Também não se verificaram diferenças significativas entre as freguesias dirigidas por autarcas do género feminino face à comparação com freguesias lideradas por autarcas do género masculino.

The transparency of the administration is a condition for the effective participation of citizens in the formation of decisions or deliberations that concern them, so it was very important to verify, if the path taken by the Presidents of the parish councils of the Braga district allowed the citizens a fair assessment of their municipal action during the term of office from 2013 to 2017. With the Law that establishes the legal regime for local government (RJAL), that allowed the transfer of responsibilities (contracted) in favor of parishes, the inter-administrative contracts emerged, through which the municipality delegates powers that are its own, in the parishes, transferring the respective funds for their implementation. It was considered very relevant to verify if there is transparency in the publicity of the funds received for the implementation of the delegation with the municipality, based on the assumption that the difference between the amount received and the amount advertised is a failure in public values, making other values impossible, such as transparency and accountability. In this study, a descriptive analysis was carried out of all the municipalities in the district of Braga, according to the political-party alignment between the Municipality and the Parish Councils, gender and the number of the term of office of the elected, the political ideology, the number of residents of the parishes and the academic qualifications of the elected. To verify the influence of these variables, the probit model was used and a test of the significance was carried out, using a t test. The results obtained in the present study revealed a great difference between the values transferred from the municipalities to the parishes and the values published by these. The tests carried out showed that the political-party alignment and the number of the term of office exert a negative influence on transparency, unlike the variable population of parishes, which exerts a positive influence. Regarding the number of the mayors' mandate and ideology, it was found that they also exert a negative influence on transparency. The t-tests carried out on political-party alignment and on the gender of mayors showed that the difference in averages found between politically aligned parishes is not statistically significant when compared with politically non-aligned parishes. There were also no significant differences between parishes headed by female mayors compared to parishes led by male mayors.
