Resumo(s): | Quando alguém morre, coloca-se a questão do destino a dar aos seus direitos e
obrigações que não se extinguem com a morte.
Para responder a tal questão, existe um conjunto de normas jurídicas que formam um
todo sistemático e coerente a que se dá o nome de Direito das Sucessões.
O Direito das Sucessões faz parte do Direito Civil e surge tratado no Livro V do Código
Civil português, o qual se divide em quatro títulos: Das Sucessões em Geral, Da Sucessão
Legítima, Da Sucessão Legitimária e Da Sucessão Testamentária.
É entendimento de parte da doutrina que a relevância social da família deve ser
assegurada pela sucessão, o que apenas se consegue quando, no âmbito da sucessão legal, a
par da sucessão legítima (de natureza supletiva), exista a sucessão legitimária de carácter
injuntivo a favor da família, entendida esta no sentido nuclear do termo, ou seja, cônjuge,
descendentes e ascendentes.
Através da sucessão legitimária, a lei garante a favor dos herdeiros legitimários, uma
porção de bens ainda que contra a vontade do autor da sucessão.
A presente dissertação tem por objetivo essencial analisar o regime da sucessão
legitimária e a sua (in)compatibilidade com a proteção constitucional do direito à propriedade
privada e a sua transmissão, em vida ou por morte, e da iniciativa privada, consubstanciada no
princípio da liberdade contratual, princípio fundamental do direito civil português.
O estudo que aqui se apresenta procura evidenciar a necessidade de alterar o regime da
sucessão legitimária, revogando-o, de modo a garantir plenamente o direito à propriedade
privada e à sua livre transmissão bem como o respeito pelo princípio da autonomia da vontade
subjacente a todo o direito privado. When someone dies, the question that worth our attention is the destiny of rights and obligations that do not end with death. To answer this question, there is a set of legal rules that form a systematic and coherent whole called the Succession Law. The Succession Law is a part of Civil Law and is dealt on Book V of the Portuguese Civil Code, which is divided in four titles: the General Successions, the Legitimate Succession, the Legitimary Succession and the Testamentary Succession. It is understood from part of the doctrine that the social relevance of the family must be assured by the succession, which can only be achieved when, in the scope of the legal succession, along with the legitimate succession (of a supplementary nature), there is the legitimary succession of a mandatory family´s side, understood to be in the nuclear sense of the term, i.e., spouse, descendants and ascendants. Through the legitimary succession, the law guarantees in favor of the legitimate heirs, a portion of assets even if against the will of the succession´s author. This dissertation has the main goal of analyze the legitimary succession regime and it´s (in)compatibility with the constitutional protection of the right to private property and it´s transmission, in life or death, and the private initiative, embodied in the principle of contractual freedom, fundamental principle of portuguese civil law. The present study seeks to demonstrate the need to change the legitimary succession regime, by revoking it, in order to fully guarantee the right to private property and it´s free transmission as well as the respect for the autonomy principle of the will underlying to all private right. |
