aplicação destas à figura do crime tributário continuado, bem a própria figura jurídica do crime
tributário continuado. The purpose of this dissertation is to study the rules of law enforcement in time in continuous tax crimes. The approach is based on the fact that the general rules of application of the law at the time of the Criminal Code are subsidiarily applied to the RGIT, and that there is a special regime for determining the moment of the practice of the fact in the RGIT which, although it is quite close to the provisions of article 3 of the Criminal Code, raises some questions. Consequently, as all the rules of application of the law in time are conditioned by what is defined as the relevant legal moment for the production of legal effects, if we do not know for certain when the same is verified, serious uncertainties will arise when applying the law in time. With the aggravating factor that may be at stake is the subsumption of such rules to the legal figure of the continuous tax crime. Therefore, we propose a study of all these matters that will allow us to have a deep understanding of the general rules of law application in time in RGIT, the special rule of determining the moment of the practice of article 5 of RGIT, the relations between the two, their application to the figure of the continuous tax crime, as well as the legal figure of the continuous tax crime itself. |
