Resumo(s): | família tem sofrido grande evolução na nossa sociedade ao longo dos tempos, transformandose
profundamente. A aquiescência universalizada do divórcio no seio familiar provocou alterações
essenciais nas novas formas de organização da estrutura da família. Bem assim, a promoção do
princípio da igualdade entre os cônjuges e a alteração da conceção da criança e dos seus direitos
representam uma ínfima porção das problemáticas que reclamam a atualização dos preceitos legais,
que numa constante mutabilidade tentam acompanhar a evolução dos tempos. Foi tal intento que se
encontrou subjacente na lei n.º 61/2008, de 31 de outubro.
Uma dessas problemáticas reflete-se no número abismal de casos de incumprimentos de
acordos que definem o exercício das responsabilidades parentais, que tanto entopem os nossos
Tribunais de Família, e onde na maioria das vezes os ex-esposados vão discutir as nuances negativas
0do seu casamento e se esquecem que o que importa é o interesse dos filhos. Tal rusticidade da
situação levou o legislador a criminalizar tal comportamento, no art. 249.º, n.º 1, al. c), do CP, de
forma a que, assim, não se rompessem os laços entre as crianças e o progenitor que é obstaculizado
de com ela contactar.
No entanto, parece que legislador pareceu ainda não adivinhou as soluções para os casos de
violência ou abuso familiar.
Será que o legislador não promoveu de forma insuficiente interesses generalistas, em
detrimento da personalização do superior interesse do menor, a figura mais desprotegida e que mais
sofre nestes casos?
Por isso, iremos analisar o santificado ilícito da subtração de menor que reclama a
injustificação do incumprimento do acordo do exercício das responsabilidades parentais. Mas, e
quando este incumprimento é justificado? The family has undergone great evolution in our society through the ages, transforming itself deeply. The universalized acquiescence of divorce within the family has brought about essential changes in the new forms of organization of the family structure. The promotion of the principle of equality between the spouses and the alteration of the child's conception and rights represent a small part of the problems that call for the updating of the legal precepts, which, in a constant mutability, try to follow the evolution of the times. It was such an attempt that was found underlying Law no. 61/2008, of October 31. One of these problems is reflected in the abysmal number of cases of breaches of agreements that define the exercise of parental responsibilities, which are so bogged down by our Family Courts, and where in the majority of cases ex-spouses will discuss the negative nuances of their marriage and forget that what matters is the interest of the children. Such rusticity of the situation led the legislator to criminalize such behavior, in art. 249 (1), al. (c) of the CP, so that the ties between the children and the parent who is prevented from contacting them would not be broken. However, it seems that legislator appeared to have not yet guessed the solutions to cases of violence or family abuse. Has not the legislator insufficiently promoted general interests, to the detriment of the personalization of the best interest of the child, the most unprotected and suffering person in these cases? For this reason, we will analyze the unlawful sanctification of the subtraction of minor that claims the injustice of the non-fulfillment of the agreement of the exercise of the parental responsibilities. But when is this breach justified? |
