Resumo(s): | Na presente, o objectivo fundamental prende-se com a exposição em vários itens
sobre que ampara o tema deste trabalho, nomeadamente direito de audição do contribuinte.
No nosso ordenamento jurídico, antes da tomada de decisão final por parte da
Administração deverá o contribuinte ser notificado desta sempre que contenda com os seus
interesses. Este princípio tem uma relevância fulcral, embora poucos sejam os sujeitos que
o entendem. O seu fim é de dar a conhecer aos contribuintes a possível decisão de modo a
que estes se possam pronunciar sobre ela, podendo chegar mesmo a alterá-la. No entanto,
não nos devemos olvidar que este é um direito e não uma obrigação, pendendo sobre o
interessado o seu exercício ou não.
Ao longo deste trabalho, vamos percepcionar o sentido e alcance do direito de
audição e quando há lugar à aplicabilidade deste princípio no âmbito do procedimento e do
processo Tributário. Vamos discorrer sobre as várias fases em que o contribuinte deve ser
ouvido e quando a sua audição está dispensada. Caso não o esteja e a Administração pretira
esta fase, o ato por esta praticado torna-se inválido. Remonta às brumas do tempo a
discussão sobre a aplicação do regime da nulidade ou da anulabilidade. Certo é que o ato
com a preterição de uma formalidade essencial é um ato anulável, podendo esta degradarse
em formalidade não essencial por via do princípio do aproveitamento do ato.
Este é um tema de fulcral importância nos dias que correm, uma vez que num
mundo em constante mutação cabe-nos perceber o que nos rodeia, impendendo sobre nós o
peso de entender as normas com as quais todos os dias lidamos. De maiores considerandos
dispensando-me nestas breves linhas remeto para o teor do texto que se segue. At the present, the fundamental objective is the exhibition in several items on what supports the theme of this work, in particular the taxpayer’s right to be heard. In our legal system, before the final decision by the Administration should the taxpayer be notified whenever the decision contends with their interests. This principle has a central significance, although few are the ones who understand. His purpose is to inform the taxpayers of the possible decision so that they can comment on it and even change it. However, we must not forget that this is a right and not an obligation, hanging over the interested the right to exercise it or not. Throughout this work, we will achieve the meaning and reach of the right to be heard and when there is place for the applicability of this principle in the procedure and tax process. We will talk about the several phases in which the contributor must be heard and when his hearing is discharged. If not and the Administration omits this stage, the act becomes invalid. Dating back to the mists of the time, the discussion on the application of nullity or annulment. It is true that the act with the infringement of an essential formality is an act cancellable, which may deteriorate in formality nonessential because of the principle of use of the act. This is a central theme of importance these days, because we are in a world in constant mutation, and its up to us to understand what surrounds us, and impends on us the weight of understand the rules with which we deal everyday.
