O financiamento ao devedor no âmbito do PER e o regime dos "novos créditos": uma análise do artigo 17.º-H do CIRE

Abstract

Com este estudo pretendemos analisar o financiamento concedido ao devedor no âmbito do Processo Especial de Revitalização e o regime dos “novos créditos”, analisando o disposto no artigo 17.º-H do CIRE, único artigo referente ao financiamento. São várias as questões que se levantam quanto à sua interpretação e aplicação. No entanto, este artigo tem um tratamento escasso tanto na Jurisprudência como na Doutrina. Em particular, pretendemos fazer uma reflexão crítica e levantar algumas questões, dando algumas, possíveis, respostas. Concluímos que os incentivos que o legislador tentou criar para que os credores concedessem financiamento ao devedor são insuficientes e que o legislador poderia e deveria ter ido mais longe.

With this study we intend to analyze the financing granted to the debtor under the “Processo Especial de Revitalização” and the system of "new loans", analyzing article 17.º-H of CIRE, the only article on financing. There are several issues that arise regarding its interpretation and application. However, this article has a scarce treatment both in Jurisprudence and in Doctrine. In particular, we intend to make a critical reflection and raise some questions, giving some possible answers. We conclude that the incentives that the legislator tried to create so that creditors grant financing to the debtor are insufficient and that the legislator could and should have gone further.
