Resumo(s): | Em resposta ao apelo do Secretário-Geral das Nações Unidas, Kofi Annan, a
Comissão Internacional sobre a Intervenção e a Soberania Estatal (ICISS) desenvolveu
e apresentou em 2001 a Responsabilidade de Proteger (RdP). O relatório foi adaptado
pela Organização das Nações Unidas (ONU) e os seus princípios incorporados nos
mecanismos de avaliação de conflitos da organização. A Responsabilidade de Proteger é
uma derivação da Guerra Justa e procura prevenir e reagir a situações em que os
Estados não têm capacidade para proteger a sua população de crimes de atrocidade em
massa, ou não o fazem deliberadamente.
A Líbia representa o primeiro Estado a ser alvo de uma aplicação
multidimensional da Responsabilidade de Proteger, destacando-se a intervenção militar
no país em 2011 com o objetivo de proteger a população líbia da repressão violenta do
governo.
O principal objetivo desta investigação é revelar de que forma o tratamento dos
discursos e processos enquadrados pela Guerra Justa e Responsabilidade de Proteger
podem contribuir para o agravamento da instabilidade sofrida por comunidades
vulneráveis a atrocidades. Mais concretamente pretende-se analisar de que forma a
intervenção militar na Líbia afetou a segurança da população e revelar os efeitos a
médio prazo para a ordem e segurança regional.
Esta investigação demonstra que é possível reunir Estados e organizações
diferentes e que - face ao perigo de crimes de atrocidade em massa - a comunidade
internacional é capaz de providenciar uma resposta rápida e adequada à situação.
Todavia o estudo da intervenção na Líbia comprova também que a falta de compreensão
da génese do Estado intervencionado pode levar a novos focos de insegurança. In response to the Secretary-General’s appeal, the International Commission on Intervention and State Sovereignty (ICISS) developed and presented, in 2001, the Responsibility to Protect (RtP). The report was incorporated into the United Nations (UN) and its principles imbedded into the conflict prevention mechanisms of the organization. The Responsibility to Protect derived from the Just War doctrine and aims at preventing and reacting to cases in which the State is unable or unwilling to protect its population from mass atrocity crimes. Libya represents the first State to be sanctioned with a multidimensional action under RtP, emphasizing the military intervention carried out in the country in 2011 in order to protect the Libyan population from the government’s violent repression. The main aim of this investigation is to reveal how the discourse and proceedings framed by Just War and Responsibility to Protect may contribute to the worsening of the instability felt by those vulnerable to atrocity crimes. More specifically, it is intended to examine how the military intervention in Libya has affected the population’s security and reveal the mid-term effects in order and regional security. This study argues that it is possible to bring together different States and organizations and – in the face of atrocity threat – the international community is able to provide a timely and adequate response to the situation. Although, the study also accounts for the lack of understanding of the intervened State and how this can help breed new security threats. |
