Resumo(s): | Nos últimos anos atravessamos num período conturbado de
crise, marcado pela necessidade de aplicação de medidas de redução
da despesa pelo Governo. A iminência de colapso financeiro do Estado
obrigou a um pedido de assistência internacional que resultou na
adoção de severas medidas anticrise. Em simultâneo, os mesmos
cidadãos sofreram os efeitos de um aumento de impostos que afetou
de forma global todos os cidadãos do nosso país. Como resultado da
adoção de tais medidas, vários cidadãos, em particular aqueles que se
encontram vinculados ao setor público sofreram inúmeros cortes nos
seus salários e subsídios. Essa alteração nas suas vidas levou a que
muitos questionassem a eficácia da proteção conferida aos direitos
sociais.
A nossa tarefa foi determinar em que medida os direitos sociais
estão protegidos contra alterações legislativas que diminuam
significativamente a sua concretização. Para isso, fizemos um
levantamento dos mecanismos internacionais de proteção de direitos
sociais a que Portugal está vinculado e exploramos o regime
constitucional desta categoria de direitos na nossa ordem jurídica. Após
a determinação do grau de proteção que recai sobre os mesmos,
procedemos a uma análise jurisprudencial de modo a compreender se
o Tribunal Constitucional cumpriu a sua função de atuar como guardião
da Constituição. In recent years we went through a difficult period of crisis, marked by the need to implement measures to reduce spending by the government. The imminent financial collapse of the state forced the government to request international assistance which resulted in the adoption of strict anti-crisis measures. As a result of the adoption of such measures, a number of citizens, particularly those who are linked to the public sector suffered numerous cuts in their salaries and allowances. Simultaneously, the same citizens have also suffered the effects of a tax increase that affected globally all citizens of our country. This change in their lives led many to question the effectiveness of the protection granted to social rights. Our purpose was to determine the extent to which social rights are protected against legislative changes that significantly impair their implementation. To achieve our goal, we determined which are the international protection mechanisms of social rights that Portugal is bound to and explored the constitutional regime of this category of rights in our legal system. After determining the degree of protection that they benefit, we proceeded to a jurisprudential analysis as a way to understand whether the Constitutional Court fulfilled its role to act as the guardian of the Constitution. |
