Título: | Parcerias público-privadas em Portugal: accountability, modelos e motivações subjacentes |

Resumo(s): | Num cenário de evolução dos paradigmas de Estado e de transformação da governação
pública, as Parcerias Público-Privadas (PPP) têm vindo a afirmar-se crescentemente em Portugal.
Entendidas genericamente como formas de colaboração entre atores públicos e privados, as PPP
encerram em si diversas modalidades que assumem expressão em diversos setores de atividade.
No âmbito desta pesquisa, assumimos a destrinça essencial entre PPP contratuais e
colaborativas, procurando saber se têm gerado as condições que lhes garantem uma boa
implementação e corresponder com as exigências de accountability pública. Nesse sentido, colocámos
os seguintes objetivos específicos para a pesquisa: (a) perceber as motivações para a celebração das
PPP; (b) identificar as diferenças dos modelos contratual e colaborativo de PPP; (c) conhecer os
fatores que são críticos para uma boa decisão e implementação das PPP; (d) aferir o mérito atual das
PPP estudadas; (e) saber que mecanismos de accountability estão a ser usados nas PPP; e (f) avaliar
a eficácia da utilização destes mecanismos perante a exigência de prestação de contas públicas.
O trabalho foi prosseguido com base num modelo teórico-concetual desenvolvido a partir da
revisão da literatura de caráter interdisciplinar. A literatura destacou os diferentes entendimentos sobre
o conceito das PPP, mas discute-se se as PPP contratuais terão inerente o caráter de parceria. O
balanço efetuado à realização das PPP revela graves deficiências iniciais, pelo que continuam
pertinentes a ponderação dos fatores críticos para o sucesso e a avaliação dos projetos de PPP, tendo
por referência a sua complexidade técnica e aplicação no contexto da governação, onde se requer o
cumprimento do interesse público. O tema da accountability nas PPP não está ainda suficientemente
explorado, mas reconhece-lhes diversas caraterísticas que a tornam particularmente difícil, com
possibilidade de défice no exercício das suas funções democrática, legal e de desempenho.
O design de pesquisa assumiu-se como qualitativo, de tipo semi-indutivo e semi-interpretativo,
com pretensões de explorar, conhecer e explicar o nosso objeto de estudo, as PPP. Para o efeito,
recorremos a quatro estudos de caso que envolveram diversos setores de atividade e níveis de
Administração Pública (Estado e municípios). Deste modo, selecionámos duas PPP contratuais, uma
do setor das infraestruturas rodoviárias (Concessão Grande Lisboa) e outra das águas, saneamento e
resíduos (Águas de Cascais), e duas PPP colaborativas, uma do setor da regeneração urbana (PRU
Bairro Padre Cruz) e outra das águas, saneamento e resíduos (FAGAR). As duas PPP do setor das
águas foram utilizadas numa perspetiva comparada e as duas restantes foram analisadas
individualmente.
A análise e discussão dos resultados levou-nos a concluir que os aspetos financeiros parecem
constituir o móbil fundamental para a celebração das PPP, embora se procure justificá-las com base no interesse público decorrente da prestação do bem ou serviço público. As duas PPP contratuais
espelham bem o conceito do ponto de vista do desenho institucional, mas o mesmo não acontece com
as duas PPP colaborativas. Deste modo, a FAGAR assemelha-se a uma PPP de tipo contratual e falta
paridade entre os parceiros na PRU Bairro Padre Cruz. Os fatores críticos identificados na literatura
revelaram-se importantes nos nossos estudos de caso. Salientamos os aspetos pré-contratuais, a boa
definição do contrato e o modelo de gestão e acompanhamento nas PPP contratuais. Nas PPP
colaborativas, revela-se muito importante a paridade e amplo envolvimento dos atores, a confiança e a
liderança na relação, a qual se pretende bastante interativa. Ao nível do mérito, dois casos afiguram-se,
neste momento, mais duvidosos: a Concessão Grande Lisboa e a FAGAR. Depois de um início
atribulado, os parceiros da Concessão Águas de Cascais conseguiram estabelecer uma boa relação,
pelo que o futuro se perspetiva como positivo, ainda que o parceiro privado esteja em via de pedir um
reequilíbrio da concessão. Da PRU Bairro Padre Cruz, a única em fase de conclusão, é feito um
balanço geral positivo, embora se reconheça que não foi conseguida na sua plenitude.
Pudemos observar a existência de uma multiplicidade de mecanismos de accountability nas
PPP estudadas, combinando mecanismos verticais tradicionais, com outros de natureza mais
horizontal ou diagonal. Desta forma, identificámos mecanismos de tipo administrativo, político, legal,
profissional e social, embora nem todos com a mesma relevância. Apesar da existência da
multiplicidade de meios, persiste um défice na accountability efetuada. A accountability administrativa
assume alguma complexidade, mas com margem de progressão e melhoria, face às lacunas existentes
(especialmente graves no caso dos transportes). Ao nível político, observa-se que existe prestação de
contas insuficiente do Governo ou Câmara Municipal para as Assembleias da República e Municipal.
Ainda assim, a legitimidade parece ser maior nos casos municipais. Durante muito tempo o tema ficou
para lá das preocupações dos cidadãos. Face à complexidade inerente às PPP e a um nível de
transparência abaixo do desejado, a accountability social saiu prejudicada. O trabalho do Tribunal de
Contas, em prol da legalidade, é de destacar na accountability legal. Por último, pareceu faltar, muitas
vezes, a suficiente autonomia à accountability profissional. Existe, concretamente, dificuldade de
proceder a investigações científicas independentes, face aos obstáculos para o acesso completo à
informação. In a scenario of evolution of the paradigms of state and transformation of public governance, Public-Private Partnerships (PPPs) have been adopted increasingly in Portugal. Generally understood as forms of cooperation between public and private actors, PPPs adopt various forms with expression in various sectors of activity. Within this research, I assume the essential distinction between contractual and collaborative PPP, asking whether they have generated the conditions that guarantee them a good implementation and can correspond with the requirements of public accountability. Therefore, I established the following specific research objectives: (a) to understand the reasons for the celebration of PPPs; (b) to identify the differences between contractual and collaborative models of PPP; (c) to understand the critical factors to good decision-making and implementation of PPPs; (d) to evaluate the current merits of the studied PPPs; (e) to identify the accountability mechanisms which are being used in PPPs; and (f) to assess the effectiveness of these mechanisms to meet the requirements of public accountability. I carried out this work by using a theoretic-conceptual model, which was developed with the resource of an interdisciplinary literature review. The literature highlighted the different understandings of the concept of PPP, but it discusses if contractual PPP have inherent character of a partnership. The balance made of the implementation of PPPs revealed early serious deficiencies, so it is still relevant to consider the critical success factors and the evaluation of PPP projects, having in mind their technical complexity and their implementation in the context of public governance, which requires the compliance with the public interest. The theme of accountability in PPPs was not sufficiently explored, but the literature attributes them several characteristics that make it particularly difficult. Therefore, there is a possible deficit in the exercise of the democratic, legal and performance functions of accountability. The research design is qualitative, semi-inductive and semi-interpretive, with pretensions to explore, understand and explain the object of study, PPPs. To this end, I selected four case studies involving different sectors of activity and levels of government (state and municipal). Thus, I elected two contractual PPPs, one of the road infrastructure sector (Concessão Grande Lisboa) and other of the water, sanitation and waste industry (Águas de Cascais), and two collaborative PPPs, one of the urban regeneration sector (PRU Bairro Padre Cruz) and another of water, sanitation and waste sector (FAGAR). The two PPP's from the water sector were used in a comparative perspective and the remaining two were analysed individually. Analysis and discussion of results led me to the conclusion that financial aspects seem to be the fundamental motive for the celebration of the PPPs, although they were justified on the basis of public interest arising from the provision of public goods or services. Both contractual PPPs reflect well the theoretical concept from the point of view of institutional design, but the same did not happen with the two collaborative PPPs. Thus, FAGAR resembles a PPP of contract type and PRU Bairro Padre Cruz lacks parity among partners. The critical factors identified in the literature have proven important in our case studies. I emphasize the pre-contractual aspects, the good definition of the contract and the management and monitoring model on contractual PPP. In collaborative PPP, it proved to be very important parity and broad involvement of partners, and trust and leadership in the relationship, which is intended to be highly interactive. Concerning merit, two cases appear to be at this moment more doubtful: the Concessão Grande Lisboa and FAGAR. After a troubled start, the partners of Águas de Cascais managed to establish a good relationship, so the future perspectives as positive, eventhough the private partner is preparing to ask a financial rebalance of the concession. PRU Bairro Padre Cruz, the only project that is nearing completed, has an overall positive balance, although it full dimension was not achieved. I observed the existence of a multiplicity of mechanisms of accountability in studied PPPs, combining traditional vertical mechanisms, with others of more horizontal or diagonal nature. Thus, I have identified administrative, political, legal, professional and social mechanisms of accountability, though not all with the same relevance. Despite the existence of a multiplicity of means, there is still a deficit in the performance of accountability. Administrative accountability owns some complexity, but with room for improvement, addressing its deficiencies (especially serious in the case of transport PPP). At the political level, I observed that there is insufficient provision of accounts of the Government or Municipality for Parliament and Municipal Assemblies. Still, the legitimacy seems to be higher in municipal cases. For a long time the issue of PPPs was beyond citizens’ concerns. Social accountability was damaged given the inherent complexity of PPPs and its level above the desired transparency. The work of the Court of Auditors, for the sake of legality, should be highlighted regarding legal accountability. Finally, it seemed to lack often enough autonomy to professional accountability. Concretely, there was some difficulty of carrying out independent scientific research, given the obstacles to full access the information. |
