Perícias forenses de agressores conjugais: caracterização e impacto nas sentenças judiciais

Abstract

O fenómeno da violência conjugal é uma realidade cada vez mais presente na nossa sociedade. Ainda que não se revelem como um grupo homogéneo, comumente o agressor conjugal é aquele que coloca em risco a integridade física e psicológica do seu conjugue. Assim, a avaliação forense deste tipo de agressores centra-se na identificação de fatores de risco presentes na sua história de vida que possam precipitar atos violentos. O presente estudo teve como principal objetivo perceber qual o impacto das perícias psicológicas forenses, efetuadas a agressores conjugais, na tomada de decisão judicial. Uma vez que se tem assistido a um crescente número de pedidos de perícias forenses por parte dos tribunais, achamos pertinente averiguar, então, qual a importância concedida a tal prova. Assim, de forma a responder ao nosso objetivo de estudo, analisámos 14 perícias forenses, realizadas pela Unidade de Consulta de Psicologia da Justiça da Universidade do Minho (UCPJUM), entre 2005 e 2010, e a respetiva sentença judicial. Para tal, recorremos a uma metodologia qualitativa, mais concretamente à análise de conteúdo categorial. Verificámos que a maioria das decisões judiciais ia de encontro às principais conclusões apontadas no relatório pericial, ou seja, em 57, 1% dos casos havia concordância entre o parecer do perito e a decisão judicial. Foi também possível verificar que, em 78,6% das sentenças estava referenciada, de alguma forma, a existência do relatório pericial, como por exemplo, através de transcrições diretas de frases da perícia, ou apenas referência a aspetos mencionados naquela. Adicionalmente, com o intuito de conhecer também a prática pericial entre os peritos da UCPJUM, realizámos uma caraterização das avaliações bem como do relatório pericial, recorrendo ao software estatístico, IBM SPSS, na versão 19.0. Os resultados mostram que a prática pericial entre os psicólogos que exercem funções na respetiva unidade se revela semelhante entre eles. Pudemos, então, constatar que se assiste a uma maior interligação entre a Psicologia e o Direito, que se reflete no gradual número de pedidos de perícias forenses, requeridas à UCPJUM, nos últimos anos. Assim, concluímos que a perícia psicológica se revela como um importante instrumento de trabalho que auxilia o juiz na tomada de decisão judicial.

The phenomenon of domestic violence is an ever-present reality in our society. Although not prove to be a homogenous group, usually the aggressor is the one who married endangers the physical and psychological integrity of your spouse. Thus, the forensic evaluation of such offenders focuses on identifying risk factors in their life history that may precipitate violence. This study aims to determine what the psychological impact of forensic expertise is, made to the marital aggressors, in judicial decision making. Since there has been an increasing number of a request for forensics by the courts, we appropriately determined, then, what is the importance given to such evidence. In order to meet our goal of study, we analyzed 14 forensics, undertaken by the Unidade de Consulta de Psicologia da Justiça da Universidade do Minho (UCPJUM) between 2005 and 2010 and its judicial sentences. For such, we use a qualitative methodology, more specifically to the analysis of categorical content. We found that the majority of court decisions going against the main conclusions pointed out in the expert report, in other words, in 57 of the court’s decisions, there was an agreement between the expert's opinion and judicial decision in 1% of the cases. It was also concluded that, 78.6% of the sentences were referenced, in some way to the existence of the expert report, for example, through direct transcriptions of sentences of expertise, or just the aspects mentioned in that reference. Additionally, in order to also meet the practice of forensic within the experts of UCPJUM, we conducted a characterization of the assessments and the expert report, using the statistical software, IBM, SPSS, version 19.0. The results show that the practice of forensic psychologists who exercise functions in the respective unit reveals similar between them. We could then see that we are witnessing a greater interconnection between psychology and law, which is reflected in the gradual number of requests for forensic, required to UCPJUM in recent years. Thus, we conclude that psychological expertise is revealed as an important working tool that assists the judge in judicial decision making.
