Resumo(s): | O estudo da relação entre estrangeiros e criminalidade tem vindo a ganhar
relevância à medida que o sentimento global de insegurança e a “ameaça racial” se vão
tornando mais comuns. Ainda que Portugal apenas recentemente se tenha tornado um
país de acolhimento de imigrantes, a preocupação com a sua influência negativa na
sociedade, nomeadamente da sua contribuição para o aumento dos índices de
criminalidade, já existe. E apesar de os números mostrarem que a imigração em
Portugal ainda é reduzida, o legislador tem vindo, nos últimos anos, a legislar sobre
matéria de imigração e asilo, no sentido de limitar a admissão de estrangeiros no país.
Por outro lado, apesar de os estrangeiros não apresentarem índices de criminalidade
preocupantes, estes encontram-se sobre-representados entre a população prisional.
Nesta dissertação, avaliou-se a situação dos estrangeiros em Portugal, no que
concerne ao seu envolvimento e tratamento penal, ou seja, a existência de uma relação
causal entre a nacionalidade do indivíduo e a sentença proferida. Mais concretamente,
avaliou-se a eventual diferença no seu tratamento, ao nível das disparidades quanto à
incidência da aplicação da prisão preventiva, condenação a pena de prisão, maior
severidade da pena aplicada e condições de cumprimento da pena. Para tal, utilizou-se
um questionário elaborado de raiz, que foi enviado a um universo de juízes de direito a
exercerem em duzentos e vinte e sete tribunais de primeira instância, em duzentas e
vinte e três comarcas. Através deste, procurou-se saber quais as motivações das decisões
envolvendo cidadãos estrangeiros, quais os factores de ponderação distintos utilizados
nestes casos e qual a avaliação da evolução do envolvimento de estrangeiros em
processos penais. Pediu-se que, para tal análise, se baseassem na sua experiência
profissional. Foi utilizado um design não experimental, tipo cross section.
Verificou-se que os juízes deliberam de forma semelhante quanto a portugueses
e estrangeiros. Por norma, o estatuto de estrangeiro não é tido em conta para a
determinação da pena, nem mesmo se este não residir em Portugal. Terá, contudo,
influência no cumprimento da pena, visto que a inexistência de uma rede social e
familiar de apoio poderá significar a ausências de medidas de flexibilização. Por outro
lado, o facto de os estrangeiros envolvidos em processos-crime possuírem, em regra,
baixo estatuto sócio-económico, poderá prejudicar a sua relação com o sistema judicial. The study of the connection between the presence of foreign citizens and criminality is achieving an increasing importance as the global feeling of insecurity and “racial threat” are becoming more common. Though Portugal has only recently become a host country for immigrants, the concern about their malign influence in society, namely their contribution for high crime rates, is already present. Though figures show that immigration is still quite low in Portugal, for the past few years, the legislator have been passing new laws of immigration and asylum, with the goal of limiting the admission of foreign citizens in the country. Also, even though there is no evidence of higher crime rates, foreigners are over represented in prisons. In this thesis, we evaluated the situation of foreigners in Portugal, concerning their penal involvement and treatment, meaning, the existence of a connection between the nationality of the criminal and the sentence received. More precisely, we evaluate the eventual difference in their treatment, concerning the disparities in remand sentences, prison sentences, harsher penalties and enforcement of the penalty. For that, we used an original survey that we sent to a population of court judges, working in two hundred and twenty seven courts in two hundred and twenty three districts. Through this, we seeked to know which are the motivations of the decisions concerning foreigners, which are the different factors they use to motivate their decisions concerning foreigners and their evaluation of the evolution of the presence of foreigners in criminal procedures. We asked them to analyse it based on their professional experience. We used a non experimental design, cross section style. We found that judges deliberate similarly when there are Portuguese and foreigners. In general, the status of being foreigner is not taken into account in the motivation of the penalty, not even if the foreigner does not live in Portugal. Nevertheless, it will have some influence in the enforcement of the penalty, since the inexistence of a supporting social and family background may cause that there will not be any flexibilization of the enforcement. On the other hand, the fact that foreigners in criminal procedures are, mostly, from low income status may have a negative influence in their relationship with the criminal justice system. |
