Um breve olhar axiológico-normativo sobre o arresto preventivo

Abstract

As medidas de garantia patrimonial assumem um cariz eminentemente económico, traduzindo-se em instrumentos perspetivados pelo legislador com o escopo de assegurar o pagamento de determinadas quantias, que previsivelmente podem vir a ser devidas no âmbito de um processo crime. Estas medidas assumem, por isso, uma relevância notória, no âmbito de um sistema que pretende, em primeira instância, proteger o bem jurídico violado. A inexistência de medidas desta natureza faria o Estado, enquanto responsável pela administração da justiça penal, incorrer na possibilidade de a sentença condenatória ser meramente simbólica. Não será, contudo, irrazoável indagar sobre se, atentos os pressupostos e o regime que determina a aplicação (e manutenção) destas medidas, não se poderá colocar o visado numa situação excessivamente onerosa, quando as necessidades cautelares não o exijam.

The measures for asset guarantee take on an eminently economic nature, which translates into instruments envisioned by the legislator with the intent of ensuring that certain sums are paid, which predictably may be requested as part of a criminal action. As such, these measures become considerably relevant, within the scope of a system that intends to, in the first place, protect the violated legal asset. The lack of measures of this nature would make the State, which is responsible for administrating criminal justice, incur in the possibility of having criminal sentences become merely symbolic.It is not, however, unreasonable to inquire whether, given the prerequisites and the regime that determines the application (and maintenance) of these measures, it may not be possible to place the subject in an extremely compromised situation, when precautionary needs don’t require so.
