O princípio da solidariedade no Pacto Ecológico Europeu: implicações na integração europeia

Abstract

A proteção do ambiente é tema central no quadro político-jurídico-normativo da União Europeia e é transversal a toda e qualquer definição e execução das ações da União. A investigação teórica deste trabalho concentra-se na análise do princípio da solidariedade no Pacto Ecológico Europeu e se, a partir deste cenário, existe alguma repercussão na integração europeia. Nesse sentido, o escrito preocupa-se, num primeiro plano, em conceituar a palavra solidariedade e contextualizá-la, já como princípio jurídico, no direito da União, com a intenção de compreender como referido princípio revela-se como fundamento e fim da União Europeia. A partir dessa análise, num segundo plano, o trabalho volta-se para a tutela ambiental na União Europeia tanto num viés jurídico quanto político, com enfoque neste último ao citar e detalhar o Pacto Ecológico Europeu. Para tanto, apoiado no reconhecimento do Pacto Ecológico Europeu como «política emancipatória» que visa à neutralidade climática até 2050, uma sociedade mais equitativa com transição justa, de modo a não deixar ninguém para trás e uma mudança de lógica de crescimento econômico dissociada da utilização dos recursos naturais, o escrito pormenoriza como o princípio da solidariedade — muito embora não expresso no documento — norteia todo o roteiro de estratégias traçado pelo Pacto Ecológico Europeu, sob os mais diversos formatos de princípios jurídicos outros. Para além disso, propõe-se analisar cada princípio identificado como manifestação do princípio da solidariedade nas estratégias do Pacto Ecológico Europeu e como todo o documento, principalmente no pilar do Mecanismo para um Transição Justa, tem na solidariedade seu fundamento e fim no direcionamento de ações concertadas para se atingir os objetivos do Pacto. Tal e qual a própria União Europeia. Com isso, intenta-se comprovar e criar um paralelo entre as razões e os objetivos do Pacto Ecológico Europeu e a essência da União de Europeia, e como a solidariedade que fundamenta e objetiva os dois projetos entrelaçam-se. A conclusão passa pela avaliação de que é factível que o Pacto Ecológico Europeu reafirma e reforça o processo de integração europeia.

Environmental protection is a central theme in the political-legal-normative framework of the European Union, and it is transversal to any definition and execution of the European actions. The theoretical investigation of this dissertation focuses on the analysis of the principle of solidarity in the European Green Deal and whether, from this scenario, there is any repercussion on European integration. In this sense, this paper is concerned, at first, with conceptualizing the word solidarity and contextualizing it, as a legal principle, in European Union law, with the intention of understanding how that principle reveals itself as the foundation and end of the European Union. From this analysis, secondly, the work turns to environmental protection in the European Union from both a legal and political standpoint, focusing on the latter by citing and detailing the European Green Deal. To this end, based on the recognition of the European Green Deal as an «emancipatory policy» aimed at climate neutrality by 2050, a more equitable society with a fair transition so as not to leave anyone behind and a change in the logic of economic growth dissociated from the use of natural resources, the paper details how the principle of solidarity - although not expressed in the document - guides the entire roadmap of strategies outlined by the European Green Deal, under the most diverse formats of other legal principles. Moreover, it is proposed to analyse each principle identified as a manifestation of the principle of solidarity in the strategies of the European Green Deal and how the entire document, especially in the pillar of the Just Transition Mechanism, has in solidarity its foundation and end in directing concerted actions to achieve the goals of the Green Deal. As the European Union itself. With this, it is intended to prove and create a parallel between the reasons and objectives of the European Green Deal and the essence of the European Union, and how the solidarity that underlies and aims the two projects are intertwined. The conclusion is that it is feasible that the European Green Deal reaffirms and reinforces the European integration process.
