dc.description.abstract | A presente dissertação tem como fim a análise de situações em que face a uma alteração da qualificação jurídica em sede de instrução ou julgamento, existe consequentemente uma alteração da própria natureza do crime, transformando um crime de natureza pública num crime(s) de natureza semipública ou particular. A título exemplificativo utilizou-se o crime de violência doméstica atendendo à sua possibilidade de integrar normas que estão entre si em concurso aparente, seja por se tratar de uma relação de consumpção ou de especialidade, o que comporta especial complexidade e dificuldade às autoridades judiciais em subsumir os factos a um tipo-legal de crime, uma das principais razões pelas quais se assiste a situações recorrentes de alteração de qualificação jurídica de crime do violência doméstica para crimes de natureza semipublica ou particular nomeadamente para crimes de ofensa à integridade física e injúria. Face ao escasso escrutínio doutrinal, foram analisadas enumeras decisões jurisprudenciais onde se assistiu a uma diversidade de qualificações do vício oriundo das repercussões a nível processual da problemática estudada, assim como das suas consequências, onde foram identificadas seis “teorias” (cientes que existirão mais) relativamente à sua classificação, denominadas por nós por “Teoria da nulidade insanável”, “Teoria da nulidade sanável”, “Teoria da irregularidade”, “Teoria da extinção do procedimento criminal”, “Teoria da extinção do procedimento criminal com sanação do vício” e “Teoria da inexistência do vício”. Após a análise das várias teorias e confrontando-as com a compatibilização dos princípios gerais do processo penal, direitos e garantias de defesa do arguido e direitos do ofendido, sugeriu-se uma proposta de solução através de uma alteração legislativa ao Código Penal e Processo Penal. | por |
dc.description.abstract | The aim of this dissertation is to analyze situations in which, in the face of a modification in the legal qualification in the investigation or trial, there is consequently a change in the very nature of the crime, transforming a crime of a public nature into other crime(s) with a semi-public or private nature. As an example, the crime of domestic violence was used given its possibility of integrating rules that are in apparent competition, either because it is a relationship of consumption or specialty, which entails special complexity and difficulty for the judicial authorities in subsuming the facts under a legal type of crime, one of the main reasons why there are recurring situations of change in the legal classification of crime from domestic violence to ones with a semi-public or private nature, namely to crimes of offense to physical integrity and injury. In view of the scarce doctrinal scrutiny, numerous jurisprudential decisions were analyzed where a diversity of qualifications of the vice arising from the repercussions at the procedural level of the problem studied, as well as its consequences, were identified six "theories" (aware that there will be more) in relation to its classification called by us as “Theory of irremediable nullity”, “Theory of curable nullity”, “Irregularity Theory”, “Theory of the extinction of criminal proceedings”, “Theory of the extinction of criminal proceedings with cure for the vice” and “Theory of the non-existence of vice”. After analyzing the various theories and comparing them with the compatibility of the general principles of criminal procedure, rights and guarantees of defense, of the accused and the rights of the offended, a proposal for a solution was suggested through a legislative amendment to the Criminal Code and Criminal Procedure. | por |
