Resumo(s): | Decorridos seis anos desde a reforma operada pela Lei n.º 23/2013, de 5 de março, o
legislador português colocou um fim à experiência de «desjudicialização» do processo de inventário,
reconhecendo que a solução não foi a mais adequada e que não logrou os objetivos para a qual foi
pensada.
Com início de vigência no primeiro dia de 2020, a Lei n.º 117/2019, publicada no dia 13 de
setembro, veio repor a competência prioritária no âmbito dos processos de inventário nas mãos dos
Tribunais Judiciais terminando, assim, com a obrigatoriedade de tramitação notarial imposta pelo
regime revogado.
Por conseguinte, esta judicialização do inventário fez regressar este processo especial à
sistemática do Código de Processo Civil, mantendo, porém, um regime paralelo de inventário notarial
em diploma autónomo.
Neste sentido, consagrou-se um princípio de competência concorrente que tornou optativa a
tramitação do inventário nos Cartórios Notariais ou nos Tribunais Judiciais que, naturalmente, implicou
alterações na tramitação dos processos consoante a entidade decisora e sobre as quais pretendemos
refletir. Elapsed six years since the reform operated by the Law n. º 23/2013, of March 5th, the Portuguese legislator placed an end to the experience of «dejudicialization» of inventory process, recognizing that the solution was not the most adequate and that didn’t fulfill the goals for which it was thought. With the beginning of vigency on the first day of 2020, the Law n.º 117/2019, published on the day 13 of September, came to reinstate the priority competence in the scope of inventory process in the hands of Judicial Courts, thus, putting an end to the mandatory notorial tramitation imposed by the revoked regime. Consequently, this judicialization of the inventory made this special project return to the systematic of the Civil Process of Code maintaining, however, a parallel regime of notarial inventory in autonomous diploma. In this sense, it was consecrated a principle of competitor competence that made the tramitation of inventory in the Register Officers or in Judicial Courts optional which, naturally, implied alterations in the tramitation of processes according to the decision-making entity and about which we intend to reflect. |
