Lawfare no âmbito da pós-democracia: estudo sobre o uso perverso de normas e procedimentos jurídicos para fins de perseguição política

Abstract

A presente dissertação de mestrado versa sobre o fenômeno do lawfare no âmbito da pós-democracia de forma a analisar a aplicação ilegal das normas e procedimentos jurídicos como instrumento de perseguição política. Com esse objetivo principal, dividimos o estudo em duas partes, onde na primeira serão analisadas as características do que se teoriza como estado pós-democrático para, em seguida, se escrutinar o conceito de lawfare do ponto de vista latino-americano do fenômeno. Dessa forma, pretende-se verificar tanto a origem, como a relação entre os fenômenos, que aparenta passar por questões sociais, políticas e econômicas que convergem sob a ótica da racionalidade neoliberal. Logo após, com o objetivo de verificar na prática a hipótese ventilada, realiza-se na segunda parte do estudo uma análise cronológica de três casos jurídicos brasileiros que, por grande parte do século XXI, ocuparam a agenda e o noticiário do Brasil de forma a desempenhar papel importante na alteração das forças políticas do país. Pretende-se, dessa forma, compreender como é criado o ambiente social, político e jurídico apropriado para o manejo do lawfare como instrumento jurídico de perseguição política. Por fim, o estudo busca refletir sobre os rumos da democracia brasileira – inserida na realidade latino-americana – em tempos tão desafiadores.

This master's dissertation deals with the phenomenon of lawfare in the context of post-democracy in order to analyze the illegal application of legal norms and procedures as an instrument of political persecution. With this main objective, we divided the study into two parts, in which the characteristics of what is theorized as a post-democratic state will be analyzed, in order to scrutinize the concept of lawfare from the Latin American point of view of the phenomenon. Thus, it is intended to verify both the origin and the relationship between the phenomena, which appear to involve social, political, and economic issues that converge under the perspective of neoliberal rationality. Afterwards, with the objective of verifying in practice the proposed hypothesis, in the second part of the study, a chronological analysis of three Brazilian legal cases that, for a large part of the 21st century, occupied the agenda and the news in Brazil, playing an important role in changing the country's political forces. It is intended, therefore, to understand how the appropriate social, political and legal environment for the handling of lawfare as a legal instrument of political persecution is created. Finally, the study seeks to reflect on the direction of Brazilian democracy – inserted in the Latin American reality – in such challenging times.
