Resumo(s): | Com a presente dissertação temos por objetivo analisar as prerrogativas jurídico-sucessórias relacionadas com o nascimento de um filho póstumo do autor da sucessão, por via
da técnica de Inseminação Artificial post mortem.
A admissibilidade da técnica em análise, ou neste caso, a sua falta, tem sido palco de
discussão a nível nacional, motivando a que os partidos políticos se unificassem no sentido de
quebrar as injustiças que o ordenamento jurídico político potencia com a sua proibição.
Deste modo, a elaboração da presente dissertação tem como finalidade estudar os
problemas suscitados por esta técnica e quais as soluções que a doutrina e a jurisprudência têm
adotado face ao status sucessório que o filho póstumo, necessariamente, reclama.
Cumpre, desde logo, arrazoar a inadmissibilidade da técnica na lei portuguesa e os
problemas que daí decorrem, nomeadamente, o direito de dispor do material genético após a
morte e o estatuto jurídico dos concepturos. Para, a final, indagarmos acerca do estremecimento
profundo que os pilares do direito sucessório português sofrem, aquando da utilização, ainda que
contra legem, desta técnica de procriação medicamente assistida post mortem, particularmente,
no que à partilha da herança diz respeito e os efeitos práticos daí decorrentes.
Com objetivo final de oferecer um verdadeiro contributo para o Direito haverá lugar a uma
proposta legislativa, com base na estirpe decisória de outros ordenamentos jurídicos e na realidade
da sociedade moderna. With this dissertation we aim to analyze the legal and inheritance prerogatives related to the birth of a posthumous child of the author of the succession, through the post mortem Artificial Insemination technique. The admissibility of the technique under analysis, or in this case, its lack, has been stage for discussion at national level, motivating the political parties to unite in order to break the injustices that the political legal system promotes with its prohibition. Thus, the preparation of this dissertation aims to study the problems raised by this technique and what solutions the doctrine and jurisprudence have adopted in view of the succession status that the posthumous child necessarily claims. It is necessary to understand the reasons why Portugal provides for the inadmissibility of the technique and the problems that arise from it, namely, the right to dispose of genetic material after death and the legal status of conceptus. Finally, we inquire about the profound trembling that the pillars of Portuguese succession law suffer, when using, although against their will, this technique of medically assisted post mortem procreation, particularly with regard to the sharing of inheritance and the effects practical consequences arising therefrom. With the ultimate objective, by offering a true contribution to the Law, there will be a legislative proposal, based on the decision-making lineage of other legal systems and on the reality of modern society. |
