A perspetiva jusfundamental do acesso à Internet no ordenamento jurídico da União Europeia

Abstract

Na sociedade de hoje, o acesso à Internet é essencial no quotidiano de grande parte dos cidadãos. Para além de ser um meio de comunicação entre as pessoas, e um meio que permite obter informação em massa, é igualmente uma ferramenta que possibilita o exercício de outros direitos. No fundo, o acesso informacional configura uma nova forma de exercício de direitos já existentes, como, por exemplo, o direito de acesso à educação: quando a crise pandémica obrigou toda a gente a fazer quarentena, foram as tecnologias que garantiram este direito fundamental. É, também, inegável a importância que o acesso informacional tem nos dias de hoje no combate ao fosso digital, responsável por grandes desigualdades sociais. Neste sentido, a consagração de um direito de acesso à Internet como fundamental parece ser o próximo passo da sociedade informacional, ainda mais num espaço cuja integração jusfundamental é evidente como é o caso da União Europeia.

In today’s society, Internet access is vital in the daily lives of most citizens. Besides being a means of communication between people, and a means of obtaining mass information, it is also a tool that enables the exercise of other rights. Basically, informational access configures a new way of exercising existing rights, such as, for example, the right to access education: when the pandemic crisis forced everyone to quarantine, the technologies were crucial to ensure this fundamental right. It is also undeniable the importance of informational access in the struggle against digital divide, responsible for huge social inequalities. In this sense, the enshrinement of a right of access to the Internet as fundamental seems to be the next step for the information society, even more in a block whose fundamental integration is evident as is the case of the European Union.
