A intervenção tutelar educativa: questões em torno da (in)eficácia e da natureza jurídica da medida de internamento em centro educativo em regime fechado

Abstract

A presente dissertação de mestrado centra-se na temática exordial da delinquência juvenil com foco na prevenção, na responsabilização e nos fatores potencializadores dos comportamentos transgressivos à lei por menores. Salienta-se que, pertinente à delinquência juvenil, a intervenção do Estado nos jovens infratores enseja-se na determinação de medidas tutelares, com o escopo de educação para o direito e inserção, de forma responsável, do menor na sociedade. Todavia, apuram-se contradições e inconsistências na execução da medida de internamento em regime fechado em centro educativo, visto que, na prática, não há o devido cumprimento das finalidades pedagógica e socializadora imprescindíveis para a eficácia e legitimidade da natureza jurídica educativa da medida supramencionada. Por conseguinte, compreende-se que a medida institucional é ineficaz para os fins que lhes foram pretendidos e culmina no desvio do caráter educativo para a essência punitiva e sancionatória previstas nas leis penais.

This master's thesis consists of the exordial theme of juvenile delinquency focusing in the prevention, accountability and the potential factors of transgressive behavior by minors. It is noteworthy that, in juvenile delinquency, the State intervention in young offenders is done by the determination of tutelary measures, with the scope of education for the Law and insertion, with dignity, of the youth in society. However, there are contradictions and inconsistencies in the execution of the internment measure in a closed regime in an educational center, since, in practice, there is no proper fulfillment of the pedagogical and socializing purposes essential for the effectiveness and legitimacy of the educational legal nature of the measure of internment. Therefore, it is understood that the institutional measure is ineffective for the purposes intended for them and results in the deviation from the educational character to the punitive and sanctioning nature of penal laws.
