dc.description.abstract | A presente investigação científica está diretamente relacionada com a prova no processo penal e com as dimensões que lhes são inerentes, nomeadamente, princípios e institutos jurídicos. Contudo, devido à multiplicidade de questões que podem ser abordadas quando se estuda um tema tão abrangente, a escolha do tema principal recaiu nas proibições de prova. A matéria proibições de prova é problemática desde a sua génese até às considerações posteriores que são realizadas. As questões que surgem não têm uma solução unânime. O próprio conceito é já por si uma temática controversa, pois não existe uma definição conceitual inequívoca e universal. É um tema que procede de um amplo interesse, devido à sua natural complexidade, como também pelos reflexos que faz sentir no sistema jurídico. No nosso ordenamento jurídico, a prova assume um papel de grande complexidade e de grande importância. Acontece que na tarefa de valoração da prova existe uma dificuldade, a verdade. A verdade não tem um valor absoluto, o que significa que não é possível delimitar uma justificação para todos os atos que sejam executados na subordinação desta finalidade. Tem que existir uma ponderação pelos direitos fundamentais e, por isso, não é viável negligenciar o cuidado e ponderação pelos direitos, liberdades e garantias. Deste modo, o presente estudo tem como objetivo a análise do alcance da verdade no processo penal e o ponto em que se pode admitir o uso de institutos jurídicos, como o da prova proibida, em prol do alcance da verdade e da justiça. Surge também a reflexão de indagar acerca da justiça que se perpétua no processo se tais admissões forem possíveis de ser aplicadas. | por |
dc.description.abstract | The present scientific research is directly related to the evidence in criminal proceedings and the dimensions inherent to them, namely, legal principles and institutes. However, due to the multiplicity of issues that can be addressed when studying such a comprehensive subject, the choice of the main theme focused on the prohibitions of evidence. The subject of prohibitions of evidence is problematic from its genesis to the subsequent considerations that are undertaken. The questions that arise do not have a unanimous solution. The concept itself is already a controversial subject, as there is no unequivocal and universal conceptual definition. It is a topic that is of broad interest, due to its natural complexity, as well as, due to the reflexes it has on the legal system. In our legal system, proof assumes a role of great complexity and importance. It so happens that in the task of evaluating evidence there is a challenge, the truth. Truth does not have an absolute value, which means that it is not possible to delimit a justification for all acts that are carried out in subordination to this purpose. There has to be a weighting for fundamental rights, and therefore it is not feasible to neglect the care and weighting for rights, liberties and guarantees. Therefore, this study aims to analyze the reach of the truth in the criminal process and the point at which the use of legal institutes, such as the prohibited evidence, can be admitted in favor of reaching the truth and justice.
