dc.description.abstract | Trata-se de pesquisa científica realizada para a obtenção de título pelo Curso de Mestrado em Ciência Jurídica da Universidade do Vale do Itajaí́ – UNIVALI, inserindo-se na área de concentração “Fundamentos do Direito Positivo”, vinculando-se àlinha de pesquisa “Direito e Jurisdição”, com dupla titulação pela Universidade do Minho – UMinho/Portugal, pelo Mestrado em Direito da União Europeia. O presente estudo pretende retratar o fenômeno da transnacionalidade e do direito transnacional, e da sua incidência na formação e na criação do Direito da União Europeia, com foco no âmbito de aplicação universal do Regulamento Europeu Sucessório – RES – nº 650/2012, de 4 de julho de 2012 do Parlamento Europeu e do Conselho da União Europeia. O seu objetivo científico é destacar o aspecto transnacional do ordenamento jurídico da União Europeia em matéria sucessória de que trata o Regulamento (UE) n.º 650/2012 (RES), desde a sua origem pelos Tratados constitutivos da União Europeia, quanto pelos princípios basilares em que se sustenta, e investigar, sob a ótica da transnacionalidade, a efetividade da aplicação universal dos atos normativos em matéria sucessória da União Europeia, circunscrevendo-se ao âmbito da “competência” e da “lei aplicável”, em face da “regra geral” do artigo 21 e da regra da “escolha da lei” do artigo 22, do RES. Esta análise visa oferecer critérios para avaliar, ao final, o potencial de incidência e aplicação deste regulamento, no ordenamento jurídico brasileiro, a partir de cenários hipotéticos, antecipando as probabilidades de reconhecimento ou não das decisões emanadas dos órgãos jurisdicionais da União Europeia. dc.description.abstract | This is a scientific research carried out to obtain a title by the Master's Course in Legal Science at the University of Vale do Itajaí́ - UNIVALI, within the concentration area “Fundamentals of Positive Law”, linked to the research line “ Law and Jurisdiction ”, with a double degree from the University of Minho - UMinho / Portugal by the Master in Law of the European Union. The present study focuses on portraying the phenomenon of transnationality and transnational law and its impact on the formation and creation of European Union law, with a focus on the universal scope of the European Succession Regulation - RES - nº 650/2012, of 4 July 2012, adopted by the European Parliament and the Council of the European Union. Its scientific objective is to highlight the transnational aspect of the European Union's legal system in matters of succession covered by Regulation (EU) No. 650/2012 (RES), since the its origin by the constitutive Treaties of the European Union, as well as by the basic principles on which it is based, and to investigate, from the perspective of transnationality, the effectiveness of the universal application of the normative acts in matters of succession of the European Union, being limited to the scope of “competence ”And the“ applicable law ”, in view of the“ general rule ”of article 21 and the“ choice of law ”rule of article 22, of RES. This analysis aims to offer criteria to assess, in the end, the potential for incidence and application of this regulation, in the Brazilian legal system, based on hypothetical scenarios, anticipating the probabilities of recognition or not of the decisions issued by the European Union jurisdictional bodies.
