Resumo(s): | A verticalidade dos valores tutelados pelo Estado, no seio do seu ius imperii, encontra-se
seriamente ameaçada, na medida em que a resposta formal do sistema clássico de justiça, face a
determinados comportamentos criminógenos, tem vindo a revelar-se inadequada, tardia e não
raramente, ineficaz.
Decorrente da falta de concretização das necessidades das vítimas e das legítimas expectativas da
comunidade, a procura de outras formas alternativas de resolução de litígios, mais céleres,
reintegradoras e capazes de humanizar todo o processo penal, tem vindo a tornar-se uma realidade
cada vez mais imprescindível.
Nesta medida, vem a mediação penal, enquanto mecanismo de aplicação, ampliação e
desenvolvimento do direito, num quadro de clara confrontação entre o ius puniendi estadual e as
liberdades constitucionalmente consagradas, oferecer um contexto desafiador para o estudo da
temática.
Assim, o objetivo subjacente à escolha do tema prende-se com a fundamental necessidade de
compreensão das limitações de que o Sistema de Mediação Penal padece, em contraponto com a
miríade de potencialidades que pode representar para o direito processual penal.
Deste modo, pretende-se indagar sobre um tema, que atendendo à sua evolução e amplitude
legal, requer uma apreensão multidisciplinar, envolvendo diferentes dimensões do saber, que se
afiguram essenciais para o conhecimento geral do cidadão e, em especial, para o aprofundamento de
conhecimentos de todo o jurista. The uprightness of the values protected by the State, within its ius imperii, is seriously threatened, as the formal response of the classic justice system, in the face of certain criminogenic behaviors, has proved to be inadequate, late and not rarely, ineffective. Due to the lack of realization of the needs of the victims and the legitimate expectations of the community, the search for other alternative forms of dispute resolution, which are faster, reintegrating and capable of humanizing the entire criminal process, has become increasingly real. more essential. In this measure, comes the criminal mediation, as a mechanism of application, expansion and development of the law, in a context of clear confrontation between the state ius puniendi and the constitutionally enshrined freedoms, offering a challenging context for the study of the theme. Thus, the objective underlying the choice of the theme is related to the fundamental need to understand the limitations that the Criminal Mediation System suffers, in contrast to the myriad of potentialities that it can represent for criminal procedural law. In this way, it is intended to inquire about a theme, which, given its evolution and legal scope, requires a multidisciplinary apprehension, involving different dimensions of knowledge, which appear essential for the general knowledge of the citizen and, in particular, for the deepening of knowledge of the entire jurist. |
