O papel do direito do trabalho no reforço dos Direito Humanos: a OIT face à crise migratória europeia

Abstract

Esta pesquisa buscou responder em que medida a Organização Internacional do Trabalho – OIT – foi interveniente na resposta à crise migratória europeia entre 2014 e 2019. A revisão da literatura confirmou que o ponto de partida dado por esse questionamento se justifica por uma série de fatores relevantes. Primeiramente, pelo facto de tal instituição ser pouco abordada na área das Relações Internacionais, ainda que possua estrutura singular e robusta há mais de cem anos. Além disso, por ser rara a conexão entre a regulação das relações de trabalho e as políticas para a solução de crises migratórias. Ainda, em razão de tal fenômeno ter sido o mais emblemático dessa natureza nos últimos tempos e de ter havido ação direta da OIT quanto aos seus desdobramentos. Portanto, realizou-se uma análise deste ator internacional quanto ao seu panorama histórico, mecanismos consolidados e posicionamento no sistema global como agente de cooperação multilateral. Foram também apreciadas as causas e características específicas da crise em questão e seus reflexos na esfera da OIT. Dessa forma, verificou-se que tal ator desenvolveu papel crucial para a construção de estratégias voltadas à contenção das tensões desencadeadas durante o período, tendo produzido instrumentos em pelo menos três dimensões: reforço da legislação internacional, estabelecimento de métodos de fiscalização e publicação de extenso material científico. Tendo sido adotada a Teoria Crítica no decurso da dissertação, foi possível constatar também que há uma contradição intrínseca no papel da OIT: ao passo que determina o reforço dos Direitos Humanos, chancela a exploração do trabalho pelo capital. Essa dinâmica decorre da aplicação de um modelo essencialmente contratualista às relações de trabalho, que replica a hegemonia do sistema capitalista ao contexto global, o qual merece ser substituído por uma abordagem que priorize a visão humanista dessa figura.

This research sought to answer the extent to which the International Labor Organization – ILO – was involved in the response to the European migration crisis between 2014 and 2019. The literature review confirmed that the starting point given by this question is justified by a series of relevant factors . Firstly, because this institution is rarely addressed in the area of International Relations, even though it has had a unique and robust structure for over a hundred years. Furthermore, because the connection between the regulation of labor relations and policies for the solution of migratory crises is rare. Also, because such phenomenon has been the most emblematic of its nature in recent times and because there has been direct action by the ILO regarding its consequences. Therefore, an analysis of this international actor was carried out regarding its historical panorama, consolidated mechanisms and position in the global system as an agent of multilateral cooperation. The causes and specific characteristics of the crisis in question and its effects on the ILO were also appreciated. Thus, it was found that this actor played a crucial role in the construction of strategies aimed at containing the tensions unleashed during the period, having produced instruments in at least three dimensions: reinforcement of international legislation, establishment of inspection methods and publication of several scientific research. Having adopted the Critical Theory during the dissertation, it was also possible to verify that there is an intrinsic contradiction in the role of the ILO: while it determines the reinforcement of Human Rights, it endorses the exploitation of labor by capital. This dynamic results from the application of an essentially contractualist model to labor relations, which replicates the hegemony of the capitalist system to the global context, deserving to be replaced by an approach that prioritizes the humanist vision of this figure.
