Resumo(s): | A tradição processual penal e a prática judiciária portuguesa, partilhada com ordenamentos jurídicos
europeus com os quais mantém maior conexão e proximidade, sempre se identificou com a matriz
que estabelece como regra o segredo de justiça durante as fases preliminares de investigação criminal.
Todavia, o legislador português, com a reforma do Código de Processo Penal operada pela Lei n.º
48/2007, de 29 de agosto, surpreendentemente e contra todas as espectativas rompeu com essa tradição
jurídica e separou-se, de forma isolada, desse modelo, estabelecendo como regra, para fazer valer
em todas as fases do processo penal, o princípio da publicidade, operando uma verdadeira mudança de
paradigma no modelo de comunicação da/na justiça penal, num contexto social e criminológico em
acelerada mudança e de rumo incerto, cujas alterações legislativas efetuadas pressupunham maior ponderação
e a adoção de medidas em sentido contrário.
O conteúdo programático deste trabalho pretende observar qual o impacto da mudança deste
paradigma na forma comunicacional da justiça penal portuguesa, em especial as implicações na investigação
criminal da denominada “nova” realidade criminal, assim como a sua adequação e compatibilidade
sistémica com os instrumentos jurídicos já aprovados de combate a este “novo” fenómeno criminal.
Desse modo propôs-se, como tema central, o estudo da consagração do princípio da publicidade,
como regra, na fase de inquérito do processo penal, na ótica de concordância prática entre os primados
da descoberta da verdade e a garantia dos Direitos e Liberdades Fundamentais, num contexto social
acentuadamente mediático e de comunicação em massa mas, ao mesmo tempo, de exigência comunitária
de segurança, eficácia e celeridade da investigação dos fenómenos criminais mais graves.
Neste trabalho, com auxílio das vastas opiniões doutrinárias e soluções jurisprudenciais sobre o
tema, surgidas como crítica logo após a publicação da alteração legislativa ao modelo em análise, associado
a (algum) conhecimento prático, visa fazer-se uma avaliação sobre se a forma comunicacional da
justiça penal agora estabelecida como regra é compatível com as suas finalidades.
Ainda que a publicidade e o segredo de justiça sejam dois institutos processuais antitéticos que
integram a dimensão comunicacional da justiça penal, ambos podem coabitar durante a fase de investigação
criminal se compatibilizados, propondo-se, por isso, a final, de iure condendo, soluções corretivas
e/ou complementares. The criminal procedural and the Portuguese judicial practice tradition, shared with European legal systems with which it maintains greater connection and proximity, has always identified itself with the matrix that establishes the secret of justice as a rule during the initials phases of criminal investigation. However, the Portuguese legislator, surprisingly and against all expectations, with the reform of the Code of Criminal Procedure, operated by Law n.º 48/2007, of 29 August, broke with this legal tradition and separated, in isolation, of this model, establishing as a rule, to enforce in all phases of the criminal process, the principle of publicity, operating a true paradigm shift in the communication model of/in criminal justice, in a social and criminological context in accelerated change and uncertain direction, whose legislative changes made presupposed greater consideration and the adoption of measures in the opposite direction. The syllabus of this work intends to observe the impact of the change of this paradigm in the communicational form of the Portuguese criminal justice, in particular the implications in the criminal investigation of the so-called “new” criminal reality, as well as its adequacy and systemic compatibility with the legal instruments already approved to combat this “new” criminal phenomenon. Thereby, it was proposed, as a central theme, the study of the consecration of the principle of publicity, as a rule, in the investigation phase of the criminal process, from the perspective of practical agreement between the primacy of discovering the truth and the guarantee of Fundamental Rights and Freedoms, in a social context markedly of mass communication but, at the same time, a community demand for security, efficiency and speed in the investigation of the most serious criminal phenomena. In this work, with the help of vast doctrinal opinions and jurisprudential solutions on this topic, which emerged as a critic after the publication of the legislative change to the model under analysis, associated with (some) practical knowledge, it aims to make an assessment of whether the communicational form of criminal justice now established as a rule is compatible with its purposes. Although publicity and the secrecy of justice are two antithetical procedural institutes that integrate the communicational dimension of criminal justice, both can cohabit during the criminal investigation phase if they are compatible, therefore, at the end, corrective and/or complementary solutions, de iure condendo, are proposed. |
