A ilegalidade das expulsões imediatas de migrantes nos enclaves espanhóis: Ceuta e Melilla

Abstract

As cidades de Ceuta e Melilla são enclaves espanhóis conhecidas internacionalmente por subsidiarem rechaços imediatos em suas fronteiras. Conhecidas localmente como devoluciones en caliente, estas expulsões imediatas afrontam as disposições previstas nos diversos instrumentos internacionais de Direitos Humanos. Muitas disputas entre católicos e mulçumanos ocorreram nestas cidades, os quais vieram a influenciar a forma que estes fenômenos ocorrem atualmente. De um lado, inúmeras pessoas tentam atravessar as fronteiras e buscar asilo em um novo país que apresente melhores condições de vida, de outro, há um governo que apresenta uma dura resposta às tentativas de travessia de fronteiras por parte daqueles que tentam o asilo e refúgio, além de tentar pôr fim às rotas migratórias. Este trabalho irá examinar estas violações de direitos humanos que ocorrem nas cidades autônomas, realizando uma análise em conformidade com as normativas internacionais firmadas e com a legislação doméstica espanhola. Este estudo também irá dar um enfoque especial ao recente julgado de fevereiro de 2020 emanado pelo Tribunal Europeu de Direitos Humanos sobre as Queixas de nº. 8675/15 e 8697/15 (Assunto N.D e N.T contra a Espanha) e atual tendência da política imigratória da União Europeia.

The cities of Ceuta and Melilla are Spanish enclaves known internationally for subsidizing immediate rejections at their borders. Known locally as devoluciones en caliente, these immediate rejections are contrary to the provisions of the various international human rights instruments. Many disputes between Catholics and Muslims took place in these cities, which have come to influence the way these phenomena occur today. On the one hand, countless people try to cross borders and seek asylum in a new country with better living conditions and on the other hand, there is a government that responds harshly to the attempts to cross those seeking asylum and refuge and willing to end migration routes. This paper will examine these human rights violations that occur in autonomous cities, conducting an analysis in accordance with signed international standards and Spanish domestic legislation. This study will also give a special focus to the recent February 2020 trial issued by the European Court of Human Rights on complaints of no. 8675/15 and 8697/15 (N.D and N.T against Spain) and current trend of the European Union immigration policy.
