Resumo(s): | O direito sucessório português tem por base a proteção da família, por um lado, e o
reconhecimento da propriedade privada, na sua componente de livre transmissibilidade dos
bens, por outro. Assim, trata-se de duas realidades que serão analisadas nesta dissertação, na
medida em que se limitam reciprocamente. Com efeito, demonstraremos que o direito à livre
disposição dos bens é fortemente restringido pela proteção da família concedida pelo legislador,
nomeadamente através da sucessão legitimária. Portanto, a sucessão legitimária encontra o seu
fundamento na proteção da família, mais concretamente na proteção da família nuclear,
composta por cônjuges e descendentes.
Deste modo, a sucessão legitimária opera quando existe pelo menos um herdeiro
legitimário, são estes o cônjuge, os descendentes e os ascendentes, e traduz-se na reserva de
uma quota do património do autor da sucessão a favor dos herdeiros legitimários. Com efeito, o
património do autor da sucessão fica dividido em duas partes, uma de livre disposição e outra
imperativamente destinada aos herdeiros legitimários e da qual não pode dispor. Trata-se de
uma sucessão com caráter injuntivo, na medida em que não pode ser afastada e opera mesmo
contra a vontade do de cuius. Com esta dissertação, pretendemos averiguar se se mantém a
legitimidade do instituto da sucessão legitimária na atualidade, tendo em consideração o seu
caráter injuntivo bem como a rigidez das suas normas.
Ora, a cega aplicação da sucessão legitimária leva a que coloquemos em causa a sua
admissibilidade na atualidade. De facto, este instituto revela indiferença face a situações de
maior carência económica ou de maior contributo para a construção do património. Por seu
lado, ignora também o auxílio prestado e a relação de proximidade entre o autor da sucessão e o
herdeiro legitimário, o que contribui para que se verifiquem inúmeras injustiças.
Julgamos que ao autor da sucessão devia ser concedida uma maior liberdade de
disposição dos seus bens, pois se é ele o proprietário dos mesmos deve poder escolher a quem
quer transmiti-los, independentemente de tais beneficiários serem familiares ou não. Isto porque
a riqueza atual é maioritariamente mobiliária e fruto do trabalho do seu proprietário. Deste
modo, não vislumbramos nenhum fundamento para que este seja impedido de dispor dos seus
bens, que aliás os adquiriu com o seu trabalho, a favor de quem entender. The Portuguese succession law is based on family protection, by one hand, and by the recognition of private property, in its component of the free transmissivity of the goods, on the other hand. Therefore, these are two realities that will be analysed on this dissertation, insofar as they reciprocally limit each other. Indeed, it will be demonstrated that the right to free disposition of the goods is tightly restricted by the protection of the family granted by the lawmaker, namely by reserved succession. Reserved succession finds its foundation on family protection, more specifically on the nuclear family protection, composed by spouses and descendants. Thus, reserved succession applies when exists at least one reserved heir, these are the spouse, the descendants and the ascendants, and it consists on the reserve of a certain part of the patrimony of the author of the succession in favour of his reserved heirs. Indeed, the patrimony of the author of the succession is divided in two parts, one of free disposition and another imperatively intended for the reserved heirs and of which he cannot dispose. This succession has injunctive character which means it cannot be removed and applies even against the will of the de cuius. With this dissertation, we intend to ascertain if this institute maintains its legitimacy nowadays, considering its injunctive character as well as the rigidity of its own rules. Nevertheless, the blind enforcement of reserved succession leads to question its admissibility nowadays. In fact, this institute reveals indifference facing situations of bigger economic needs or greatest contribution to the property construction. On the other hand, it also ignores the assistance provided as well as the proximity between the author of the succession and his reserved heir, which contributes to countless injustices verified. We believe that the successor should be given greater freedom to dispose of his property, since if he is the owner of the estate he should be able to choose who to transfer it to, regardless of whether such beneficiaries are family members or not. This is because the current wealth comes mainly from moveable goods and the work of its owner. So, we see no basis for preventing him from transmitting his own goods, which he has acquired due to his work, in favour of who he intends to. |
