Os direitos das pessoas idosas como questão de direitos humanos: uma análise crítica da legislação de Portugal e do Brasil

Abstract

No momento atual vivido pelas sociedades modernas, o tema do envelhecimento demográfico coletivo, da população mundial em geral, vem sendo debatido com alargada preocupação nos fóruns internacionais e nacionais, que tratam e legislam sobre esta matéria. Já percebeu-se, bem claramente que o envelhecimento da Humanidade está condicionado a melhoria nas condições básicas de vida das pessoas, especialmente com a prevenção e o tratamento da saúde. Bem como, deve-se, também, ao crescimento do conhecimento técnico-cientifico dos últimos tempos. Esta dissertação de mestrado intitulada ‘Os Direitos das Pessoas Idosas como Questão de Direitos Humanos: Uma Análise Crítica da Legislação de Portugal e do Brasil’ teve como objetivo trazer para o debate uma análise crítica e reflexiva sobre esse processo de envelhecimento demográfico coletivo, quantificado, debatido e legislado em Portugal e no Brasil, países estes que comungam uma mesma história e uma mesma língua falada e escrita. Tratou-se, portanto, de uma investigação científica qualitativa, quantitativa e interventiva sobre essa questão do envelhecimento demográfico coletivo nesses dois países luso e brasileiro. Inicialmente, como método de trabalho realizou uma consulta bibliográfica sobre esse tema em questão. O que foi seguido de uma análise da legislação vigente em ambas as Nações, de um levantamento e análise dos dados estatísticos disponíveis pelos censos demográficos e, por fim, pela elaboração conclusiva e sugetiva deste documento final de dissertação. Dessa maneira, no primeiro capítulo deste trabalho apresentam-se os fundamentos teóricos e históricos da teoria crítica no direito humano ocidental, em decorrência da dignidade da pessoa humana. O que foi seguido pelo embasamento teórico de análise das propostas legislativas sobre os direitos humanos das pessoas idosas, em Portugal e no Brasil. Da mesma maneira, buscou-se no segundo capítulo apresentar as definições mais fundamentadas sobre os conceitos de envelhecimento, velhice, terceira idade e idoso. Logo a seguir, já no terceiro capítulo, são apresentados e interpretados os dados demográficos estatísticos quantitativos, que embasaram as conclusões finais.

At the present moment lived by modern societies, the issue of collective aging of the world population in general has been discussed with enlarged concern in international and national forums that deal and legislate on this matter. Have you noticed yourself, very clearly, that aging humanity is conditioned to improvement in basic living conditions of the people, especially in the prevention and treatment of health. As well, it should also be linked with the growth of technical and scientific knowledge of recent times. This dissertation entitled ‘The Rights of Older Persons as a Matter of Human Rights: A Critical Analysis of the Legislation of Portugal and Brazil’ aimed to bring to the debate a critical and reflective about the process of aging collective quantified, debated and legislated in Portugal and Brazil. These countries who share a part of their stories and the same spoken and written language. It was therefore a scientific qualitative and quantitative intervening on the issue of aging collective in these two countries Brazilian and Portuguese. Initially, the method of work carried out a bibliographic search on the subject in question followed with an analysis of the legislation in both nations, a survey and analysis of statistical data available for the population census, and finally, the preparation of this document with conclusive and suggestive final dissertation. Thus, the first chapter of this work presents the theoretical and historical underpinnings of critical theory in Western human right, as a result of human dignity. The second chapter is related to the theoretical analysis of legislative proposals on the human rights of older people in Portugal and Brazil. Likewise, we sought in the second chapter present the definitions based on the concepts of aging, old age, old age and elderly. Soon after, in the third chapter, are presented and interpreted the quantitative statistical of demographics, that supported the final conclusions.
