Tradução do CPPT de português para inglês: as formas de defesa do contribuinte perante a Administração Tributária

Abstract

A tradução para inglês do Código de Procedimento e de Processo Tributário (CPPT), ou mais precisamente os capítulos relativos às formas de defesa do contribuinte perante a Administração Fiscal, representa a concretização de um projeto antigo da autora. O CPPT é o código que regula, entre outras matérias, a cobrança fiscal coerciva em Portugal. Não se conhece nenhuma tradução para inglês deste importante diploma legislativo, pelo que a sua tradução para a língua inglesa se reveste de grande importância. Este relatório visa apresentar a tradução executada no decorrer de um estágio supervisionado pela Autoridade Tributária e Aduaneira, sob orientação dos docentes da UMinho, especialistas nas áreas da Tradução e do Direito. Será aqui descrita a metodologia adotada, as ferramentas informáticas utilizadas, bem como as dificuldades que surgiram durante o processo de tradução e as soluções encontradas. Pretende-se ainda fazer uma reflexão crítica sobre a tradução técnica e mais especificamente sobre a tradução jurídica no âmbito dos Estudos de Tradução como disciplina científica.

The translation of part of the Portuguese Código de Procedimento e de Processo Tributário (CPPT) into English, namely the chapters on ways of protection of the taxpayer before the Portuguese Tax Administration, is the accomplishment of a longstanding project of the author of this report. CPPT is the code which regulates, amongst other things, the enforced tax collection in Portugal. There is no English version of this important legislative instrument, that’s why its translation into the English language is considered very important. This report aims at presenting the translation carried out during the traineeship supervised by the Tax and Customs Authority under the guidance of UMinho professors, specialized in the areas of translation and law. The methodology applied will be expounded, as well as the CAT Tools used. It is also intended to point out the difficulties which have arisen during the translation process as well as the solutions found. The aim is also to take a critical look at technical translation and more specifically at legal translation within the scope of Translation Studies as a scientific discipline.
