Os Institutos Públicos: o desempenho do serviço personalizado da Segurança Social na saúde com incidência no paradigma português e francês

Abstract

O Instituto da Segurança Social é um instituto público que integra a Administração Indireta do Estado. Enquanto tal e tendo em conta que se trata de uma pessoa coletiva pública cuja função consiste em assegurar determinadas funções administrativas estaduais que não revistam caráter empresarial, é importante entendermos o seu papel e reflexamente as atuações que o Estado tem através dela. Embora se trate de um serviço personalizado, o Estado não deixa de estar presente nas nossas vidas por via desta entidade. É neste âmbito que interessa percebermos qual o desempenho do Estado através do instituto da segurança social na área da saúde e assim sabermos se existe alguma relação entre o Sistema de Segurança Social e o Serviço Nacional de Saúde. Para isso basear-nos-emos nos dois direitos fundamentais que constituem o ponto de partida, o direito constitucional à segurança social e o direito constitucional à saúde. A preocupação que o Estado enfrenta de acabar com os gastos desnecessários no domínio da saúde, coloca os cidadãos numa posição de fragilidade. Cabe ao Estado, enquanto Estado Social salvaguardar essa fragilidade e intervir. A questão a que procuramos dar resposta, é a de saber se esta intervenção ocorre apenas através do Serviço Nacional de Saúde ou se o Estado intervém de outra forma, neste caso através do Instituto da Segurança Social. A resposta a esta questão leva a que apresentemos uma breve análise comparativa com a ordem jurídica francesa, conhecida por uma ampla proteção social, a fim de percebermos se, sendo ambos os países membros sujeitos aos mesmos regulamentos europeus, seguem a mesma política em termos de segurança social e de saúde. Em termos práticos, pretendemos averiguar se os sistemas de segurança social português e francês têm ou não uma participação ativa na vida dos cidadãos.

The Social Security Institute is a public institute that is part of the State Indirect Administration. As such, and taking into account that it is a public legal person whose function is to ensure certain state administrative functions that are not of a corporate nature, it is important to understand their role and reflect on the actions that the State has through it. Although it is a personalized service, the State does not cease to be present in our lives through this entity. It is in this context that it is important to understand how the State performs through the social security institute in the area of health and thus we know if there is any relationship between the Social Security System and the National Health Service. For this we will base ourselves on the two fundamental rights that constitute the starting point. We speak of the constitutional right to social security and the constitutional right to health. The State's concern to end unnecessary costs on health care, places citizens in a fragile position. It is up to the State, as a Social State, to safeguard this fragility and intervene. The question that we seek to answer is whether this intervention occurs only through the National Health Service or if the State intervenes otherwise, in this case through the Institute of Social Security. The answer to this question leads us to present a brief comparative analysis with the French legal system, known for his large social protection, in order to understand whether, as both countries are subject to the same European regulations, they follow the same policy in terms of social security and health. In practical terms, we intend to investigate whether or not Portuguese and French social security systems have an active participation in citizens' lives.
