Do internamento em regime fechado para a vida em liberdade

Abstract

O presente trabalho tem como objetivo fazer uma reflexão acerca da medida do internamento em regime fechado e as suas consequências para os jovens que a cumprem. Através da análise de vários estudos e obras sobre este tema, procurou-se perceber não só o funcionamento dos centros educativos, mas sobretudo o funcionamento do internamento em regime fechado e os seus aspetos positivos e negativos para a correta reinserção dos jovens. Ao longo do trabalho são focados vários aspetos deste processo de reinserção e a forma como o regime fechado se relaciona com os mesmos, tais como a liberdade do jovem, a forma como este vê a medida, o estigma que esta provoca ao jovem e a forma como este é visto e a facilidade ou dificuldade do regime em garantir a não reincidência. O objetivo do trabalho é perceber se a medida de internamento em regime fechado se adequa aos propósitos da lei tutelar educativa, a educação para o direito, a reeducação do jovem, ou se é uma medida que necessita de ser revista. Com estes propósitos em mente chegamos à conclusão que embora exista uma necessidade da medida do internamento, o regime fechado, mesmo que executado apenas em casos mais gravosos, parece uma medida excessiva tendo em conta os propósitos da lei tutelar educativa. Embora seja realizada uma reeducação para o direito, esta não vai completamente de encontro à realidade.

The present work aims to reflect on the internement in a closed regime and its consequences for the young people who comply with it. Through the analysis of several studies and works on this theme, we have tried to perceive not only the functioning of educational centres, but especially the functioning of internment in a closed regime and its positive and negative aspects in the correct reintegration of interned youth. Throughout the work, we focus various aspects of this reintegration process, and the way in which the closed regime relates to them, such as the freedom of the interned youth, the way the youth sees the measure, the stigma it causes to those who completed internment, the way they are percevied by society and the ease or difficulty of the regime in ensuring non-recurrence. The objective of the study is to understand if the measure of internment in a closed regime is adequate for the purposes of the tutelary law, education for the law, re-education of the young, or if it is a measure that needs to be reviewed. With these purposes in mind, we have come to the conclusion that although there is a need for the measure of internment, the closed regime, even if executed only in more serious cases, seems an excessive measure in view of the purposes of the tutelary law of education. Although the reeducation performed is done with the right purposes, it does not conform completely to reality.
