Resumo(s): | O presente trabalho aborda a problemática existente em torno do (novo) Estatuto da Vítima,
que se vazou na Lei n.º 130/2015, de 4 de setembro. O Estatuto da Vítima estabelece os direitos, o
apoio e a proteção das vítimas de criminalidade. Vem criar alterações que se pretendem de relevo
na própria estrutura do Processo Penal de modo a que a vítima do crime não seja totalmente
arredada do processo pelo qual se pretende apurar a responsabilidade pela prática do ilícito típico
criminoso.
O objeto deste trabalho consiste numa análise crítica dos princípios e direitos de proteção
das vítimas de crimes. Para o efeito, abordam-se as noções legais e doutrinais de vítima, distinguindo
esta da noção de ofendido, de assistente e de lesado, bem como o contexto do seu surgimento e as
suas implicações para o Direito Processual Penal português.
Defendemos que o Estatuto da Vítima agora criado não trouxe grandes alterações no âmbito
do Processo Penal mas permite reconfigurar a intervenção da pessoa que foi alvo da conduta
criminosa, de modo a pôr em relevo a sua intervenção, melhor satisfazendo os seus interesses. The present work faces the problematic around the new Status of the Victim created by the statute nº 130/2015 of 4 th September. The Victim`s Status establishes the rights, support, and protection of victims of crime. It pretends to create relevant changes in the structure of the criminal procedure in order to prevent the victim from being alienated from the same procedure. The purpose of this work consists in a critical analysis of the principles and rights governing the protection of victims of crimes. We will approach the legal and doctrinal concepts of victim, distinguishing the victim from the concepts of offended, assistant and injured, as well as the context of its emergence and implications to Portuguese Criminal Procedure.Law. We will defend that the status of the victim recently created has not brought about any major changes but it allows for the reconfiguration of the intervention of the person who has been the object of a criminal conduct, in order to highlight an intervention better tailored to his/her interests. |
