O assédio laboral: uma conduta a criminalizar?

Abstract

O presente estudo vai focar-se na análise do assédio laboral. Na verdade, este é um fenómeno muito antigo que tem as suas bases na história recente. No primeiro capítulo, teremos a oportunidade de analisar as diversas abordagens terminológicas do fenómeno, e os elementos constitutivos que integram o conceito jurídico do assédio laboral também merecerão da nossa parte a melhor atenção. Abordaremos, também, as diferentes classificações do assédio laboral no segundo capítulo. O capítulo terceiro tratará das consequências do assédio laboral, que se poderão repercutir, e que a verificar-se poderão influenciar as relações familiares, o bom funcionamento da organização do trabalho e a própria sociedade. Quanto ao capítulo quarto, este irá versar sobre a distinção do assédio laboral, relativamente a outras figuras afins. No capítulo quinto, será feita a análise do assédio laboral no âmbito do ordenamento jurídico português, para seguidamente nos debatermos, no capítulo sexto, se este é um fenómeno que deve ou não ser criminalizado. Para além disso, entendemos que não devem ser esquecidas as medidas preventivas e estratégicas, relativamente a este fenómeno, motivo pelo qual estas serão abordadas no capítulo sétimo.

The present study is going to focus on the analysis of mobbing. Actually, this is an ancient phenomenon that has its roots in recent history. On the first chapter, we will have the opportunity to analyze the several terminological approaches of the phenomenon, and the constitutive elements that integrate the legal concept of mobbing will also deserve from our part the best attention. We will also approach the different classifications of mobbing on the second chapter. The third fourth chapter will deal with the consequences of mobbing that can reverberate, and taking place can influence the family relationships, the good running of the organization of work and society itself. About chapter fourth, it will deal with the distinction of mobbing, comparing to other figures. On the fifth chapter, it will be done the analysis of mobbing within the Portuguese legal system, to discuss later, on the sixth chapter, if this phenomenon should or not should be criminalized. Furthermore, we understand that the preventive and strategic measures should not be forgotten, relatively to mobbing, and that is the reason why they will be approached on the seventh chapter.
