As incapacidades na sucessão legitimária

Abstract

A presente dissertação de mestrado consiste no estudo precípuo da sucessão legitimária, nomeadamente nas incapacidades sucessórias, no âmbito do Direito Sucessório português. Aqui, aflora-se a abordagem histórica dos institutos da indignidade e da deserdação, institutos que possibilitam o afastamento dos herdeiros legitimários da sua legítima. Passando por uma breve alusão ao sistema sucessório que vigora em Portugal, foca-se posteriormente na sucessão legal e suas modalidades. Outrossim já no âmbito da sucessão legitimária, se expõe sobre a posição do herdeiro legitimário e as formas que a lei lhe atribui de proteção contra as disposições do autor da sucessão que afetem a sua legítima, fazendo, assim, menção à autonomia da sucessão legitimária e natureza da vocação. Verificamos que no Direito Sucessório português, assim como no Direito estrangeiro, a sucessão legitimária e as causas de deserdação e indignidade nem sempre assumiram a mesma relevância. Parece-nos, portanto, oportuno realizar um estudo sobre as “incapacidades sucessórias” no âmbito da sucessão legitimária, percebendo qual o regime que vigora, qual a posição da doutrina portuguesa e estrangeira relativamente à questão e aquilatar uma adequada resolução que os vários sistemas jurídicos oferecem para esta quezília. Neste contexto, propõe-se a introdução de novas causas de deserdação, optando, assim, como solução, pelo modelo que se aproxima do ordenamento jurídico brasileiro, no que diz respeito às causas de deserdação.

This master dissertation consists in the foremost study of the legitimate succession, namely the disability’s, under the Portuguese Succession Law. It is intended to bring out the historical approach of the institutes of unworthiness and disinheritance, which allow the removal of the legitimate heirs from their legitim, making a brief allusion to the inheritance system in Portugal, also focusing the legal succession and its modalities. Furthermore, concerning the legitimate succession, it is stated the position of the legitimate heir and the ways of protection that the law gives against the provisions of the author of the succession affecting his legitim, mentioning, thus, the autonomy of the legitimate succession and the nature of its vocation. We found that in the Portuguese Succession Law the legitimate succession and the causes of disinheritance and unworthiness not always assumed the same relevance as in the foreign law. It seems therefore appropriate to make study on the "succession incapacities" under legitimate succession, understanding the operative regime, the position of the Portuguese and foreign doctrines on the issue and assess an appropriate resolution offered by the various legal systems for this problem. In this context, it is proposed to introduce further causes of disinheritance, choosing, as a solution, the model that approaches the German law regarding the causes of disherison.
