A resolução pelo locador do contrato de locação financeira, por falta de pagamento da renda

Abstract

O objeto da nossa dissertação incidirá sobre a resolução do contrato de locação financeira, pelo locador, por falta de pagamento da renda. A prática jurisprudencial influenciou a escolha do presente tema, em virtude de à resolução do contrato de locação financeira por falta de pagamento da renda corresponder um certo grau de litigiosidade. Por outro lado, muito se tem escrito sobre a formação e natureza do contrato em análise e, ao que sabemos, poucos há que versem especificamente sobre o tema que nos propomos tratar. O objetivo deste trabalho é analisar o fundamento da falta de pagamento da renda como pressuposto de resolução do contrato de locação financeira, abordando, especificamente, os principais conceitos jurídicos que subjazem ao tema, como sendo “Contrato de locação financeira”, “renda”, “resolução”, entre outros. Esta dissertação está dividida em quatro capítulos. No primeiro capítulo, intitulado "Contrato de Locação Financeira, Caracterização" destina-se a analisar a origem, o conceito e âmbito do contrato de locação financeira, caracterizando-o. No segundo capítulo, "A obrigação de pagar o especial de renda", veremos, que este constitui para o locatário o mais importante na economia deste contrato. Importa, portanto, avaliar, por um lado, a natureza dessa obrigação, e, por outro, as consequências da falta de pagamento da renda. Especial atenção é dada à resolução com este fundamento no terceiro capítulo. No capítulo quarto analisamos, proficuamente, o exercício do direito de resolução do locador, bem como os efeitos que daí resultam. A dissertação termina com conclusões, espaço de sintetizar, como se pretende, as principais ideias desenvolvidas neste caminho.

The object of our dissertation will focus on the resolution of the financial lease, the lessor, for non payment of rent. The jurisprudential practice influenced the choice of this theme due to the resolution of the leasing contract for non payment of income match a certain degree of litigation, evidenced by the pending litigation of this issue. On the other hand, much has been written about the formation and nature of the contract in question and, to our knowledge, there are few who specifically they concern the subject we propose to treat. The objective of this study is to analyze the grounds of failure to pay the rent as Resolution assumption of the lease contract, addressing specifically the principal legal concepts underlying, as "leasing contract", "income", "Resolution ", among others. This dissertation is divided into four chapters. In the first chapter , entitled " Financial Lease Agreement , Characterization " intended to analyze the origin , the concept and scope of the leasing contract , characterizing it . In the second chapter , called " The obligation to pay the income special." We will see ,following this , that this duty of the lessee is one of the most important in the leasing economy. Matter , therefore, assess , on the one hand , the nature of this obligation , and, secondly , the consequences of a failure in this contractual relationship. It is the third chapter we give special attention to the resolution of the leasing contract for nonpayment of rent. In the fourth chapter of our attention is given to resolving the landlord fails to comply with the duty of paying the rent: exercise of the right and typical effects. We arrived here we are confronted with the effective exercise of the right of withdrawal, the principle of continuity of contracts and deviations. The dissertation ends with conclusions where it was intended to summarize the main ideas developed throughout this work.
