A tutela jurisdicional ambiental: uma tutela civil ou administrativa?

Abstract

Este estudo debruça-se sobre a complexidade da tutela jurisdicional do direito do ambiente, partindo do ponto de vista das caraterísticas do litígio ambiental e da organização judiciária interna e internacional. Num primeiro momento, propomos uma nova leitura para uma melhor compreensão do direito do ambiente plasmado na Constituição da República Portuguesa. Num segundo momento, analisamos a tutela substantiva oferecida pelo direito privado e pelo direito público, delineando a feição do direito do ambiente. Na Parte II deste estudo, enveredando mais especificamente pela tutela jurisdicional ambiental, começamos por desenhar as caraterísticas do litígio jurídico ambiental, evidenciando a sua faceta simultaneamente pública e privada. De seguida, questionamos a organização judiciária portuguesa para se operar uma tutela adequada do direito do ambiente, analisando-se a possibilidade de criação de um tribunal ambiental com competência em razão da matéria, ponderando as vantagens e desvantagens e estudando os vários exemplos existentes noutros ordenamentos. Por último, abordamos a possibilidade de criação de um tribunal ambiental internacional, evidenciando as vantagens de uma tutela judicial à escala planetária.

The aim of this study is to analyze the complexity of the legal protection of the right to the environment, from the point of view of its characteristics and the Portuguese and international judicial systems. At first, we propose a new interpretation of the right to the environment enshrined in the Portuguese Constitution, in order to better understand it. Secondly, we examine the legal protection offered by the private and the public law, outlining the distinguishing features of the environmental law. In Part II of this study, thoroughly looking into the judicial protection of the environment, we start by drawing the characteristics of the environmental litigation, demonstrating its civil and administrative aspects. Subsequently, we question the Portuguese judicial organization in order to operate a proper protection of the environment and we analyze the possibility of creating a specialized environmental court, balancing its advantages and disadvantages and studying others examples of foreign legal systems. At last, we also examine the possibility of creating an international environmental court and the advantages of a global judicial protection.
