Resumo(s): | O Estado Novo concentrou durante cerca de cinco décadas todo o poder político,
impedindo deste modo a institucionalização de uma verdadeira descentralização
territorial. Durante este período, os órgãos do poder local, mais precisamente os
Municípios, eram meros organismos de «administração indirecta do Estado»,
controlados política, administrativa e financeiramente pelo Governo. Os Municípios
estavam destituídos de autonomia e de recursos financeiros, sendo totalmente
dependentes e subordinados ao Estado. A reação ao Estado Novo deu-se com a
Revolução de 1974, que culminou com a elaboração e aprovação da Constituição de
1976. Este diploma constitucional institucionalizou três níveis de poder políticoadministrativo,
juridicamente distintos e autónomos: o Estado, as Regiões Autónomas e
as Autarquias Locais. O poder local passou a constituir o terceiro nível de poder político
constitucionalmente consagrado, pelo que as autarquias locais deixaram de ser «meras
instâncias administrativas» e passaram a constituir uma verdadeira administração local
dotada de autonomia administrativa e financeira. As autarquias locais passaram a ter
uma importante missão: a prossecução de interesses próprios das respetivas populações.
Contudo, a prossecução destes interesses está dependente do modo de organização e
funcionamento das autarquias locais, bem como das atribuições e competências dos
respetivos órgãos. Após a aprovação da Constituição de 1976, foram vários os diplomas
legislativos ordinários que regularam a organização, funcionamento, atribuições e
competências das autarquias locais, os quais, no essencial, se limitaram a transpor
disposições previstas no Código Administrativo de 1940. Várias são as críticas
apontadas aos diplomas entretanto revogados, bem como aos diplomas em vigor.
Atualmente, a organização, o funcionamento e as competências das autarquias locais
encontram-se previstas na Lei n.º 169/99, de 18 de Setembro (LAL), na sua redação
atualizada, ao passo que as atribuições encontram-se consagradas na Lei n.º 159/99, de
14 de Setembro. Este trabalho inicia-se com uma apreciação da LAL na parte referente
ao Município, sendo que na parte final é efetuada uma análise crítica tendo em vista a
revisão em curso. The “New State” (Estado Novo) focused for nearly five decades all the political power, therefore preventing the institutionalization of a territorial decentralization. During this time the local government authorities more precisely the municipalities were mere representatives of the State’s indirect administration, controlled politically, administratively and financially by the Government. The Municipalities were deprived of autonomy and financial resources, totally dependent and subordinated of the State. The reaction to the “New State” came with the 1974 Revolution that culminated in the drafting and approval of the 1976 Constitution. This constitutional law institutionalized three levels of political-administrative power, legally distinct and autonomous: the State, Autonomous Regions and Local Authorities. Local power became the third level of political power constitutionally guaranteed, as for local authorities were no longer "mere administrative bodies" and became true local authorities endowed with administrative and financial autonomy. Local authorities now have an important mission: the pursuit of personal interests of the respective populations. However, the pursuit of these interests is dependent on the mode of organization and functioning of local authorities as well as the powers of the respective boards. After the approval of the 1976 Constitution many were the ordinary statutes that regulated the organization, function, duties and powers of local authorities, which are essentially limited to transpose provisions of the Administrative Code of 1940. However, there were several criticisms to the diplomas revoked, as well as diplomas in force. Today the organization, functioning and powers of local authorities are set out in Law No. 169/99 of 18 September (Local Authority Law - LAL) in its updated version, while the powers are enshrined in Law No. 159 / 99, September 14. This work begins with an analysis to the Local Authority Law in the section referring to the municipalities and ends with a critical analysis according to the on-going review. |
