Direito ao envelhecimento : perspetiva jurídica dos deveres familiares relativamente a entes idosos

Abstract

O envelhecimento populacional verifica-se, atualmente, presente em todos os setores da vida social, modificando a sua dinâmica cultural, social, económica e laboral. Também o Direito tem sido, paulatinamente, influenciado pelo Envelhecimento. Assim, a presente dissertação tem por objeto de estudo a influência do Envelhecimento no Direito da Família, em especial no que respeita aos deveres que sobre os familiares recaem relativamente aos idosos, não descurando os efeitos sentidos por esses mesmos familiares cuidadores, circunstância que se relaciona diretamente com o respeito pela dignidade do idoso, assentando, nessa lógica de globalidade e complexidade do paradigma de velhice, as bases de um Direito pleno ao Envelhecimento.

The aging population is, currently, present in all sectors of social life, changing its cultural, social, economic and labor dynamic. Also, the Law has been, gradually, influenced by that phenomenon. Thus, the main target of this dissertation is the study of the influence of Aging on Family Law, particularly with regard to the duties that fall on the family towards the elderly, bearing in mind the effects felt by these family caregivers, a circumstance directly related with the respect for the Dignity of Elderly, becoming, in this logic of complexity of the paradigm of old age, the basis of a full Right to Aging.
