dc.description.abstract | A informação em saúde é um tema que tem sido examinado pela doutrina quase exclusivamente na sua relação com o consentimento informado. Com o presente estudo, sem descurar o importante papel que a informação aí desempenha, pretende-se dar um tratamento mais alargado à questão da informação de saúde. Deste modo, o primeiro passo enquadra o direito à informação naquele que é o direito do qual deriva: o direito à saúde. De seguida, procede-se à análise do enquadramento normativo, conteúdo e alcance da informação devida não só ao doente, mas também a terceiros (nomeadamente, representantes legais e cuidadores informais) e aos profissionais de saúde que estão implicados no processo terapêutico. Por fim, faz-se uma aproximação às questões jurídicas mais relevantes para a efetivação do direito à informação em saúde: o tratamento da informação de saúde (a recolha, o armazenamento, circulação e acesso à informação) e a responsabilidade pela violação dos deveres informação dos vários intervenientes no plano terapêutico. Conclui-se que o direito à informação em saúde está presente em várias ciências jurídicas materiais e que só a integração de cada uma dessas perspetivas poderá fornecer uma visão adequada do direito à informação em saúde. Tornou-se patente que ainda há muito espaço para investigação no que respeita à transmissão da informação a terceiros e quanto à utilização das novas tecnologias de informação e comunicação no tratamento de dados de saúde. | por |
dc.description.abstract | Health information is a subject that has been studied by the law theory, especially in its relation with informed consent. The present study, without neglecting this important role of information, stresses the importance of health information in other contexts. Thus, the first step is to give a wider picture of the right to information starting point: the right to health. Then the legal basis of that right is analyzed as well as the content and the scope of the information due not only to the patient, but also to third parties (including legal representatives and informal caregivers) and health professionals who are involved in the therapeutic process. Finally, an approach is made to the legal issues that are most relevant to the concretization of the right to health information: the processing of health data (such as collection, storage, consultation and disclosure) and the liability for the violation of information duties, concerning the various participants in the therapeutic process. It is concluded that the right to health information is present in several field of law science and that it is necessary an integration of each of these perspectives to achieve a proper intuition of the right to heath information. It became clear that there is still room for research regarding information transmission to third parties and the use of recent information and communication technologies in the processing of health data. | por |
