O crime de violência doméstica conjugal e o exercício das responsabilidades parentais em Portugal: uma análise crítica à luz da Convenção de Istambul

Abstract

A presente dissertação se debruça na temática do crime de violência doméstica, com foco na violência doméstica conjugal, e o seu impacto na regulação do exercício das responsabilidades parentais norteando este estudo com base na Convenção de Istambul – documento internacional ratificado por Portugal. Esta investigação prospera em razão dos graves índices de violência doméstica em Portugal e a apresentação do relatório do Grupo de Peritos para o Combate à Violência contra as Mulheres e a Violência Doméstica em 2019 cuja finalidade foi tecer comentários e recomendações acerca da conduta portuguesa, especialmente à título legal, sobre estes temas. O objetivo da dissertação é analisar o conteúdo da Convenção de Istambul e investigar sobre o ordenamento jurídico português para que se possa encontrar os seus pontos convergentes e os seus pontos divergentes em matéria de violência doméstica conjugal e o seu impacto na regulação do exercício das responsabilidades parentais e, portanto, auxiliar com este esclarecimento na melhoria das práticas jurídicas e na eficácia da proteção de mulheres e crianças em Portugal. Com a devida exposição do conteúdo de ambos diplomas legais, este esclarecimento é amparado também no que foi comentado em sede do relatório do Grupo de Peritos para o Combate à Violência contra as Mulheres e a Violência Doméstica de 2019. Em primeiro lugar, vislumbra-se o conteúdo da Convenção de Istambul e o seu precedente legal, bem como a sua importância para o estudo do fenômeno da violência doméstica e de trazer a criança para o centro do debate. Posteriormente, investiga-se o crime de violência doméstica, sua evolução histórica, seu tipo penal atual, questões conflituosas sobre a matéria e as medidas político-sociais lusitanas. Em um terceiro momento, a criança e as responsabilidades parentais em contato com a violência doméstica conjugal é o objeto de estudo, verificando-se o amplo rol de direito das crianças, as situações de perigo e as problemáticas que giram em torno. Conclui-se a presente dissertação com uma averiguação da influência de uma Convenção no direito interno português e a verificação do relatório do Grupo de Peritos para o Combate à Violência contra as Mulheres e a Violência Doméstica, bem como, por fim, no esclarecimento dos elementos positivos e dos negativos pontuados no decorrer da dissertação sobre a conduta de Portugal no combate à violência doméstica e na devida proteção da criança neste contexto com base no que determina a Convenção de Istambul.

This dissertation focuses on the theme of the crime of domestic violence, with a focus on domestic violence between a couple, and its impact on the regulation of the exercise of parental responsibilities, guiding this study based on the Istanbul Convention - an international document ratified by Portugal. This investigation thrives on the grounds of the severe data of domestic violence in Portugal and the presentation of the baseline evaluation report in 2019 by the Group of Experts on Action against Violence against Women and Domestic Violence whose criticism was made comments and recommendations on Portuguese conduct, especially legally, on these topics. The objective of the dissertation is to analyze the content of the Istanbul Convention and investigate the Portuguese legal system so that it can find its converging and divergent points about conjugal domestic violence and your impact on the regulation of the parental responsibilities exercise and, therefore, assist with this clarification in the improvement of legal practices and in the effectiveness of protection of women and children in Portugal. With the due exposition of the content of both legal documents, this clarification is supported by what was commented on in the headquarters of the report published by the Group of Experts on Action against Violence against Women and Domestic Violence in 2019. It is first of all necessary to glimpse the content of the Istanbul Convention and its legal precedent, as well as its importance for studying the phenomenon of domestic violence and bringing a child to the center of the debate. Subsequently, investigate about the crime of domestic violence, its historical evolution, its current penal type, conflicting questions about the matter and the Portuguese political and social measures. In a third moment, the child and the parental responsibilities in contact with domestic violence between a couple, the object of study, being verified the broad list of children's rights, as situations of danger and as problems that revolve around. This dissertation concludes with an average of the influence of a convention on Portuguese domestic law and the verification of the report of the Group of Experts on Action against Violence against Women and Domestic Violence, as well as, finally, in clarifying the elements valid and negative points in the course of the dissertation on the conduct of Portugal in combating domestic violence and in the proper protection of the child in this context in comparison to what is determined by the Istanbul Convention.
